Francis, a white man, lived with a free mulatto woman, Emmaline Marshall, as husband and wife. They were prevented from marrying by South Carolina's anti-miscegenation laws. Francis is buried in Brotherly Cemetery, an African-American cemetery, in an unmarked grave with his son Francis Jr.

"The relatives, friends, and acquaintances of Mr. and Mrs. Francis J. Deignan, Sr., and those of his children are respectfully invited to attend the funeral services of the former at St. Peter's [Catholic] Church this afternoon at 3 o'clock."
