Civil War Union Brevet Brigadier General. He served during the Civil War first as a Captain in the 9th New York State Militia, then as Lieutenant Colonel of the 83rd New York Infantry, then finally as Lieutenant Colonel of the 22nd Veterans Reserve Corps. He was brevetted Brigadier General, US Volunteers on March 2, 1867 for "faithful services during the war". Remaining in the Regular Army, he was appointed Lieutenant and became Captain in the 44th Infantry, resigning on May 1, 1870. Relocating to the state Maryland, he later served as State Clerk of the Court of Appeals from 1897 to 1900. His ancestor was General Griffith Rutherford, of North Carolina, an officer of the Revolution, after whom Rutherford County, Tennessee, and Rutherford County, North Carolina, were named.
