Brian Patrick Foley, 44, of Dartmouth passed away peacefully at home on Friday, January 1, 2010 after courageous battle with cancer. He was the husband of Jennifer (Moore) Foley.
Born in Boston, Brian is the son of Patrick Joseph Foley of Dartmouth and Mary Theresa Kilroy of Westport. Brian was raised in Fall River and graduated from Portsmouth Abbey in Portsmouth, Rhode Island in 1984 and Lehigh University in 1988.

Brian received his Juris Doctorate from New England School of Law in Boston in 1991, where he received the New England School of Law "Book Award" for excellence in criminal law.

He passed the bar in the fall of 1991 and worked for Bristol County District Attorney as an assistant district attorney. He traveled throughout the county quickly earning the trust and respect of court staff, judges, the criminal bar, and the victims of crime. His honesty and commitment to the law earned him the trust of all and he was named Mothers Against Drunk Driving (MADD) Prosecutor of the year in 1993.

Brian left the District Attorney's Office in 1994, and opened his own law office in New Bedford. For 14 years, he was a sole practitioner, specializing in criminal defense. He practiced primarily in the District and Superior Courts, and also argued cases before the Appeals Court and the Supreme Judicial Court. He also joined the Bristol County Bar Advocates in 1995 where, as a dedicated member, he served on the Board of Directors and as a mentor to new attorneys.

Brian began his local community involvement with "Operation Clean Sweep" in New Bedford, and by offering advice and assistance to young children in need in New Bedford.

Another of Brian's passions was to help the needy. Until his illness made it unfeasible, he and his twin sons Brendan and Matthew would deliver Thanksgiving dinners to those going without through "Meals on Wheels." Brian was happiest when "at the beach" here or in Nantucket with his family. He loved music, traveling, kayaking, sports and playing rugby.

Brian closed his private practice in March 2008 and returned to the Bristol County District Attorney's Office to serve in the Assets and Forfeitures Division.

In November of 2009, Brian was honored at the annual Red Mass by the Fall River Diocese and awarded the St. Thomas More Medal.

Brian is survived by his wife, Jennifer and sons Brendan and Matthew of Dartmouth, his mother Mary Kilroy of Westport, his father Patrick Foley of Dartmouth, his brother and sister-in-law, Michael and Judy Foley and their children Owen and Sarah of Lynnfield, his sister, Kathryn Foley of San Rafael, California, and numerous aunts and uncles, cousins, nieces, and nephews.

His Funeral Mass will be celebrated on Tuesday at 10 AM at St. Mary's Church, South Dartmouth. Burial will follow in South Dartmouth Cemetery.
