WILKESBORO - Mr. Kyle Hayes, 88, of E. Main St. died Monday, Jan. 3, 1994, at Wilkes Regional Medical Center.

Funeral will be at 2 p.m. Thursday at Wilkesboro Baptist Church with the Rev. Alfred Andrews and the Rev. Harry Sellers officiating. Burial will be in Mountlawn Memorial Park.

Mr. Hayes was born in Purlear, Wilkes County, Oct. 4, 1905, to Charles C. and Ida Huffman Hayes. He was married to Margaret Smithey in 1932, who preceded him in death.

He graduated from Wake Forest University with LLB degree in 1931 and received the degree of Juris Doctor from Wake Forest University in 1970. At Wake Forest he was admitted to membership in the Golden Bough and the legal fraternity, Gamma Eta Gamma, which is no Phi Alpha Delta Legal Fraternity.

Mr. Hayes was admitted to the Bar of the State of North Carolina in February, 1930, and opened office for the general practice of law in North Wilkesboro in February, 1931. In 1937, he formed partnership with his brother, Clyde Hayes, and has been senior member of the firm of Hayes and Hayes since that time.

He was admitted to practice in all courts, including the Supreme Court of the United States, admission there being in 1946. He was a member of outstanding legal associations in the United States, including American Bar Association, Federal Bar Association, North Carolina Bar Association, North Carolina State Bar, The American Judicature Society, Wilkes County Bar Association, permanent member of the Judicial Conference for the Fourth Circuit, American Trial Lawyers Association, and Practicing Law Institute.

Mr. Hayes was a member of the Rules Making Committee of the United States District Court for the Middle District of North Carolina. He was appointed by the former Governor Luther Hodges to serve on the Committee for Improved State Courts for the State of North Carolina.

He was past president of the Wilkes County Bar Association and of the Bar Association for the 23rd Judicial District. He was a member of the North Carolina Bar Council from 1947-1950 and was a member for the Board of Governors of North Carolina Bar Association from 1970 until 1973. He was appointed by Governor Holshouser to the Judicial Council of North Carolina in January 1974.

He has been listed in the International Registry of Who's Who, Two Thousand Men of Achievement, Community Leaders of American, Who's Who in the South and Southwest, North Carolina Lives, and selected for inclusion in Library of Human Resources of the American Bicentennial Research Institute.

Mr. Hayes was a life long Republican. In the year 1936, he was the party's candidate for Congress of the Eighth Congressional District of N.C. In the year 1948, he was selected as his party's candidate for Lt. Governor for N.C. In 1956 he was selected by the party as its candidate for Governor of the State of N.C. During Kyle's active campaign for governor of North Carolina, one of the things he advocated was that community colleges be set up in North Carolina in driving distances for every student in the state. Soon after that, the elected governor fulfilled Mr. Hayes dream of community colleges. In 1960, he was the party's candidate for United States Senate for the State of North Carolina. He formerly was a member of the North Carolina State Republican Executive Committee.

Mr. Hayes enlisted in the United States Marine Corps Aug. 20, 1942, and was discharged Nov. 8, 1944 as staff sergeant. He served in Alameda and San Diego, Calif. He also served in Personnel Classification in Parris Island, S.C., and Pensacola, Fla. He was a lifetime Baptist and was a deacon and teacher of the Men's Bible Class of Wilkesboro Baptist Church, which is broadcast by local radio each Sunday.

He is past president of North Wilkesboro Kiwanis Club and Wilkesboro Business and Professional Men's Club. Mr. Hayes was a Mason, Shriner, member of the Elk's Club, Moose Lodge, and the Junior Order and Knights of Pythias.

Mr. Hayes was a former member of the Board of Trustees of Wilkes Community College, Wilkesboro, and Board of Advisors of Gardner-Webb College, Boiling Springs.

In addition to law practice, he was engaged in the retail furniture business and cattle farming. He also raised Tennessee Walking Horses and was formerly in the retail hardware business.

He is the former president of Northwestern Finance Company, which was later merged with Northwestern Financial Corporation.

The Kyle Hayes Transportation Museum was opened in June of 1993. He was very proud to be able to attend the grand opening of this long time dream of his. His memoirs, As I Remember It as Told to G. Scott Crawford, was published in June of 1993.

Mr. Hayes was the sole owner of the N.B. Smithey Stores Co., Inc. of which there are 12 department stores in western N.C.

He was preceded in death by his wife, Margaret Smithey Hayes.

Surviving is beloved friend, Ina V. Myers, his secretary for 58 years. Also by his loyal office personnel, Randy Hayes and Ina Jean Parker. Also are brothers, Mr. Tom W. Hayes of Purlear, Dr. William C. Hayes, Mr. Clyde Hayes, both of Wilkesboro; one sister, Mrs. Lucille Osborne of Wilkesboro; several nieces and nephews.

The family will receive friends 6:30-8:30 p.m. Wednesday at Reins-Sturdivant Funeral Home in North Wilkesboro.

Flowers will be accepted or memorial contributions may be made to Wilkesboro Baptist Church Building Fund.
