In 1861 Benjamin enlisted in the Confederate Army and served in Company C of the 60th Virginia Infantry Regiment until he was taken prisoner during the last year of the war. After the war he moved to Braxton County and married. He and his wife lived near the village of Frametown, Braxton County, where he bought a tract of land on Mill Creek, a tributary of Elk River, in 1885.
Benjamin's father was David Fox, born 1811 and died 1881 in Summers Co., WV, at 70 years of age. He married Mary (Polly) Ballengee in Monroe Co., VA, December 3, 1833. Mary was born 1813.
David and his family were Confederate sympathizers during the Civil War. He and three of his sons, Elfridge, Charles R., and William, were taken prisoners in their homes by Federal soldiers and taken to Camp Chase, a prison on the shores of Lake Erie at a point west of Cleveland, Ohio. At the end of 8 months they were released and sent home with the exception of Eldridge, who was believed to have been killed by Federal soldiers.
August 17,1838 David's parents conveyed to him a tract of 130 acres of land near what is now Hinton, West Virginia, probably at or near the present site of the village of Brooks, for a consideration of one dollar. His father's will, dated Jan. 4, 1844, stated that "the part of my land that I deeded to my son, David Fox, is to be his part of my estate." The deed was recorded in Greenbrier County, virginia, in DB 14 p.559, on Dec.27,1838. The following property was conveyed: "A certain tract or parcel of land, being a part of a tract of land purchased by the said William Fox of John Nichols with a reserve of that part of said land lying above the lower end of an island, for and during their natural lifetime." Greenbrier and Summers Counties.
Benjamin's Great-Grandfather was Samuel Fox, I, born in England BET. 1730-1740. Samuel died BEF. SEP 1808 in Nelson County, Virginia.
