Eldest surviving son of Sir Robert Stapleton and Elizabeth Mallory, grandson of Christopher Stapleton and Alice Aske, Sir William Mallory and Jane Conyers.

Husband of Katherine Constable, daughter of Sir Marmaduke Constable of Everingham and Jane Conyers, descendant of King Edward III. They had two sons and two daughters; Henry, Philip, Jane (wife of Christopher Wyvill) and Dorothy. Katherine died about 1580.

Secondly, husband of Olive Sharington, daughter and co-heiress of Sir Henry Sharington and Ann Paget, widow of John Talbot of Salwarpe. They had four sons and four daughters; Brian, Robert, Edward, William, Olive (wife of Sir Robert Dinely), Ursula (wife of Sir Robert Baynard), May and Grace.

Robert commanded a garrison in York against the northern rebels. Robert's career at court was destroyed by a large quarrel with Edwin Sandys, the Archbishop of York. The arguments led to a Star Chamber hearing where the Archbishop was vindicated and Stapleton was sentenced to three years imprisonment and a £300 fine.

Sir Robert was buried Oct 3rd at Wighill, Olive was living at Lacock Abbey, Wiltshire in 1634.
