Nehemiah M. Toten;

Was in Capt. Bishop's Company, Texas Troops from Navarro County, TX. In a letter, he wrote from the war he named Joe M Berry, Wash Sims and Dick Smith as being with him an all were well - were searching for conscripts and deserters in the "Brush Country"

Nehemiah Mier Toten 1832-1886 was born in 1832 many now strongly believe to John C. Toten 1801-1845 (son of Zachariah Toten 1768-1826) and Sally Gates 1805-1845 who were killed in a wagon accident in Tennessee (Gibson or Williamson County) about 1845 when Nehemiah would have been about 13. Another son of Zachariah Toten, Absolem Toten 1802-1850 (John C. Toten's younger brother) took in the orphaned child Nehemiah and any other surviving siblings. Since the 1850 census data does not show relationships many had always presumed that Nehemiah was Absolem's son, opposed to being his nephew. Recent Ancestry DNA samples from Nehemiah's descendents provides some markers pointing to Gates family, which would be impossible for Nehemiah to pass down if he were the son of Absolem and his wife but clearly could be if he were the son of Absolem's brother John C. Sadly the census would not record relationships before Nehemiah grew to adulthood. Absolem died in 1851 in Arab Marshall Alabama and is believed to be buried in the Polly cemetery with no visible marker surviving. Nehemiah's descendents are well documented as are many of Absolem's. Their relationship is then presumed to be Uncle & Nephew opposed to Father & Son. Still searching for guardianship documents etc. that might exist. Sadly I believe I personally came across it several years ago in research, but failed to associate any relationships at the time and dismissed it, without saving a copy. Lesson learned...
