JURY FAILS TO AGREE IN PROBE OF DEATH - Cause of Death of Mrs. Peter Burton near Hancock Not Determined - Body Found along Western Maryland Tracks

After deliberating for several hours, a coroner's jury probing the cause of death of Mrs. Peter Childers Burton, 16, of Hancock, was dismissed shortly before midnight after the jurors announced they could not agree.

Mrs. Burton, who before her marriage was HELEN CHILDERS, was found dead along the tracks of the Western Maryland Railway near Hancock early yesterday morning.

Her skull was crushed and investigating officers said she apparently had been struck by a Western Maryland freight about 3:30 o'clock.

Deputy Leister Isanogle, who assisted Acting Coroner Edgar Cornelius in the preliminary investigation, said early today that one of the jurors walked out about 11:45 o'clock. They had deliberated nearly three hours.

Deputy Isanogle said he would confer this morning with State's Attourney Martin L. Ingram on what action to take next. He indicated that perhaps another jury would be selected.

Evelyn and Matrona Karns, of Berkeley Springs, who were with Mrs. Burton before she started across the Potomac river bridge for Hancock, quoted her as saying she intended to commit suicide. The Karns girls said Mrs. Burton had complained of troubles with men and ill health.

The two sisters said Mrs. Burton left their car on the West Virginia side of the river about 2 o'clock yesterday morning and started walking across the bridge.

Clarence Foltz, a B. & O. employe, found the body along the Western Maryland tracks yesterday morning about 6:30 o'clock while enroute to work.

Investigating officers said their investigation indicated the young woman was seated on a track smoking a cigarette when she met her death. The stub of the cigarette was laying beside her body. The officers discounted rumors that the young woman had met with foul play.

The woman is survived by her husband, Peter M. Burton, of Paw Paw, W.Va.; parents, Mr. and Mrs. James Childers, of Hancock; three brothers, Gilbert, Frank and Henry Childers, all of Hancock; seven sisters, Mrs. Minnie Cogle, of Paw Paw; Mrs. Gertrude Mason, Paw Paw; Miss Hilda Childers, Paw Paw; Geneva, Hazel, Mary and Wanda, all at home.

Funeral services on Saturday morning at 10;30 o'clock from the Snyder-Rowland Funeral home, Hancock, by the Rev. Mr. Nelson; interment in Riverview cemetery, Hancock.
