He was married twice; little is known about his first wife, Alice. They had no children. He married second to Annie Mae Allen on December 06, 1903 in Titus County, Texas. He was the son of Bird Alexander Stephens and Martha Amanda Liles. John Harvey was a 1/8th Choctaw Indian.

For several years after their marriage John and Annie lived in (or near) Oklahoma City. Before 1909 they returned to live in Powderly, Titus County, Texas. They had the following known children:

1) Mammie Vida (b: August 17, 1904)
2) Dovie Ozelle (b: February 26, 1908)
3) Ruby Audra (b: April 04, 1910 in Texas)
4) Jess Harvey (b: September 02, 1911)
5) Mabel Ruth (b: October 31, 1916)

They were still living in Powderly during the period of WWI. They then moved back to Oklahoma, living for a while in Borgden, Johnson County, OK (1930 Census). John Harvey died in McCurtain County, OK in 1946 and is buried in an unmarked grave at Waterhole Cemetery.

Annie Mae lived on for 20 more years, dying August 15, 1966 in Hugo, Choctaw County, OK. Funeral arrangements were by Coffee Funeral Home in Antlers.
