     Herbert A. Stoots, 27, died at memorial hospital at
Princeton early Thursday morning.
     Survivors include the widow, the former Beulah
Westmoreland, and two children; the parents, Mr. and
Mrs. Harry Stoots of Echols; one brother and a sister.
     Funeral arrangements have not be completed.

     Funeral services for Herbert A. Stoots, 27, who died
at Memorial hospital at Princeton, early Thursday
morning, will be held at 2 o'clock this afternoon at Mt.
Tabor church at Harper, W. Va. The Rev. Jim Godoy
will be in charge of the services. Burial will bein the
Mt. Tabor cemetery.
     Pallbearers and flowerbearers will be selected at
the home prior to the services.

     Also slated for Wednesday is the $10,000 damage
claim of Beulah H. Stoots, administratrix of the es-
tate of Herbert Stoots against Cobert (C. E.) Pool, for
the death of Herbert Stoots. The plaintiff declares that
Pool, a contractor, excavated a ditch, 25 feet wide and
22 feet deep, on a pathway customarily traveled by
employees of the Winding Gulf Collieries to a lamp
house and mine entrance, and that Stoots enroute to
work on March 3, 1948, fell into the excavation and
broke his neck.

               Eccles Woman Gets $5,000 in Death Suit

     Beulah Stoots, of Eccles, was awarded $5,000 in a suit
against Cobert Pool, in Mercer County circuit court yes-
terday, the result of the death of her husband, Herbert
Stoots, who died as the result of a fall in an excavation
ditch.
     The plaintiff was represented by Walter Burton, of
Princeton, and Clay Crouse, Beckley attorney.

Herbert Alfred Stoots' father, Harry Franklin Stoots, survived the 2nd worst coal mining disaster in West Virginia history when on April 28, 1914 the Eccles No. 5 mine exploded and took 183 miners to their grave.
