Associate Justice Kent B. Smith 1927 - 2012 LONGMEADOW - Associate Justice Kent Benedict Smith, 85, longtime Longmeadow resident, passed away peacefully on Wednesday October 31, 2012 at Brigham & Women's Hospital in Boston, MA. Born on March 11, 1927 in Burlington, VT to the late Elmer L. and Helene (Kennedy) Smith, he received his Bachelor's Degree from American International College and graduated from Boston University School of Law in 1951 where he was named Associate Editor of the Law Review. Justice Smith was in private practice in Springfield from 1953-1972, handling civil and criminal matters. In 1954, Justice Smith became the first attorney to represent indigent criminal defendants in Western Massachusetts. In 1972 he was appointed to the Massachusetts Superior Court by Governor Francis Sargent, serving on that court until 1981 when he was appointed as an Associate Justice of the Appeals Court by Governor Edward King. After reaching mandatory retirement age in 1997, Justice Smith remained with the Appeals Court as a recall justice. He was the author of Criminal Practice and Procedure, a three-volume work in the popular Massachusetts Practice series. That work has been issued in three editions and more than twenty supplements, since its original publication in 1970. It has been cited as a respected authority on several occasions by the U.S. Supreme Court. He was a man of great strength and honor, living by the ideal that everyone is equal. He was known for his correctness, clarity and fairness. His love for the law was second only to his love for his family. He was a communicant of St. Mary's Church in Longmeadow since 1943. Justice Smith is survived by his loving wife of 49 years, Marguerite (Irwin) Smith of Longmeadow; his two grateful daughters, Barbara S. Carra and her husband Victor A. Carra, II of Longmeadow and Margaret S. Kennedy and her husband Thomas F. Kennedy of East Longmeadow; a brother, David R. Smith and his wife Kareen of Weston, CT; his grandson, Victor James Carra, II; granddaughter, Margaret Rose Kennedy and by 15 nieces and nephews. Besides his parents, he was predeceased by his brother, Elmer L. Smith, Jr., formerly of Great Barrington, MA. Family and friends are invited to meet for Justice Smith's Liturgy of Christian Burial on Monday November 5th at 10 a.m. at St. Mary's Church, 519 Longmeadow St., Long-meadow. Burial will be private. There are no funeral home services or calling hours. In lieu of flowers, donations may be made to Brigham and Women's Hospital, 75 Francis St., Boston, MA 02115 or to the charity of one's choice . Forastiere Smith is entrusted with the arrangements.
