He attended Scottsboro Academy, graduating from Winchester College in 1888, studied law at the University of the South was admitted to the bar in 1894 and practiced law in Winchester, Tennessee. He operated a large farm in Marshall County, was a member of the Tennessee House of Representatives, (1907-09) and served as chairman of the Tennessee State Senate, (1926-27). Upon the death of Governor Austin Peay, Horton was appointed as a Democrat the 36th Tennessee Governor, serving (1927-33). During his administration, legislation was enacted abolishing the twenty-percent state property tax, increasing gasoline tax for road construction and maintenance, and imposing additional taxes on tobacco to support educational programs. Not seeking reelection, he retired to his farm until his death.
