***His given name is in question: It has been seen as John, Barney, and James. Since in his marriage record and Will stated his name as Barney, that is what will be used on this memorial.
Barney Stagner's Will:
I, Barney Stagner, of the county of Madison and State of Kentucky, knowing the uncertainty of life and knowing that it is appointed once for all men to die, being weak in body but of sound mind and perfect understanding how I am going to dispose of my property. In the first place, my will and desire is that all my just debts be first paid off.
I give and bequeath unto my beloved wife, Sally, my negro girl McVitter, and her increase, during her natural life, and after her death, McVitter and her increase shall be equally divided among my children, hereinafternamed, and I also give and bequeath unto my beloved wife, Sally, one child's part, to her forever, to dispose of as she may think proper at her death.
I give and bequeath unto my son, Richmond, one bay and grey horse, saddle and bridle, two cows and calves, one bed and furniture. This is to make him equal to the rest of my legatees and not be considered as part of my estate, but only to make him equal to what I have already given them.
I give and bequeath unto my granddaughter, Sally Warden, daughter of Elijah Warden, and also daughter of my daughter, Rebeccah Warden, deceased, two hundred dollars, in right of her mother, to her and to her heirs, forever to be paid to her as her legal representative, by executors, hereinafter appointed, when the money is named, with all of my estate.
I give and bequeath unto my six children, to wit: Jesse Stagner, Anna James, John Stagner, Thomas Stagner, Elenor Morman, and Richmond Stagner, all of my estate, both real and personal, to be divided equally between them, to share and share alike, to them and their heirs or legal representatives, forever, except one sorrell horse, all which I give and bequeath unto Barney Stagner Woods, son of William Woods, of Missouri Territory, to him and his heirs forever.
It is also my desire that if any dispute should arise between my children about my estate or about the construction of this, my last will and testament, it is my will and desire that it be left to the determination of Squire Turner and Thomas J. Gentry, and their decision to finally settle the matter of dispute. I hereby nominate and appoint my friend Josiah Gentry, and my son, Thomas Stagner, sole executors of this my last will and testament. I hereby revoke all former will or wills heretofore made by me and do declare this will alone to be my true last will and testament.
