Bartholomew (or Bartlett, Bart, or Barnett) Sr. was probably born around 1735, probably in Virginia.

He met and married Barbara __ probably by 1757. Some family histories say her surname was Hundley, but the only source for this seems to be the much later marriage of a Hugh Folas to Barbara Hundley on 5 Dec 1791 in Henry Co., VA.

Bart Sr. had a brother Luke, as is shown by the 1839 will of one of Bart Sr.'s grandsons, Bart Deweese, which identified Christopher Foley, son of Luke, as Bart Deweese's cousin.

Nov 1767 - The first record found of Bartholomew so far was when he first bought land in what later became Patrick Co., Virginia. At the time it was in Pittsylvania county:

[From researcher J.T. Foley]
"Luke and Bart were brothers, they both claimed free land in the western territories of Virginia beginning in 1767 and continuing until 1768. Many of their claims are on adjoining pieces of property and as some of the claims and later deeds list the others' shared property line, they were definitely of the same generation.
Luke was in Mecklenburg Co., VA as early as 1765, but both he and Bart bought land inland that later became Patrick Co., VA in 1767. Puppey Creek is in Patrick County. At the time of the land claim it was part of Pittsylvania, but as the settlements moved westward they split off counties from Pittsylvania. Henry County was formed from Pittsylvania in 1776, then Patrick was formed from Henry in 1791. So the Foley's weren't moving, the county names were changing where they were living as the state became organized in the western parts of Virginia."

Land entry book for Halifax, Pittsylvania, Henry, Franklin, and Patrick Co., VA 1737-1770:
18 Nov 1767 - Luke Folice - 400 acres on branch of Puppy Creek adjoining lines of Barthol.w Folices' new survey at the lower end.

1770 Bartholomew was listed as a tithable in Pittsylvania Co., VA, probably while living with Barbara and their young family on their land in what was to become Patrick Co., VA:

1770 - Pittsylvania Co., VA tithables:
Bartholomew Folley 1 tithable

Jan 1778 - Henry Co., VA militia. Bartlett and a George Foley (unidentified, unless he was Luke's son Gabriel Foley) both served in the militia during the Revolutionary War. Ref. VA Historical Magazine V-17, p. 190.

The first record of Bart Sr. and Barbary Sr. in Henry Co. was when they bought land in 1780 on Sycamore Creek. They bought more land in 1785 and were next door neighbors to Bart Sr.'s brother, Luke and his wife Mary.

20 361 Luke Foley 25 Apr 1789 629 On branches of Goblingtown Creek, adjoining Adams's Order line.

Bart was not on the 1782 Henry Co., VA personal tax list.

This record from 1787 looks like some kind of vote. Some of the names have the word "disputed" after them, so apparently all identities and the right to vote were checked. All names are numbered. This is the first time that two Bart Foleys can be distinguished. The second Bart must have been Luke's son as he was not listed among Bartholomew and Barbara's heirs in 1795, but was still living in Patrick Co., VA in 1804:

09 Apr 1787(Henry Co VA DB1:530) [inserted between pp. 530-31] "A poll taken of a section of Delegates at Henry County Courthouse this 9th of April 1787 for Abraham PENN, Esq." [included the following]:

18 Apr 1788, Henry (not yet Patrick) Co., VA - Bartholomew and Barbara sell land. Barbara is not referred to in this document as "Sr.", indicating probably that her daughter Barbara isn't yet married to her cousin Jeremiah Foley:

In 1790, Bartholomew was taxed for three head of cattle, but not for himself, indicating that he was either too old or too disabled to be taxable. He is listed next to John Ferrell:

Land records indicate that Bartholomew and Barbara were near neighbors of John Burnett and Humphrey Smith on Sycamore Creek:

1793 - Bart sold land in Patrick Co., VA. Bk. 1, p. 134.

Bart Sr. died in 1793. His son-in-law Cornelius Deweese gave bond to administer his estate in Dec 1793:

Patrick Co., VA – 9 Dec 1793
Bond of Cornelius Deweese and David Morgan, Cornelius the administrator of Bartlett Foley, dec'd.

Patrick Co., VA – 23 Dec 1793, will book 1, p. 5.
Bartlett Foley inventory. Farm equipment, livestock, 3 tracts of land containing 143, 171, & 491 acres. Returned by H. Smith [Humphrey Smith], John Koger, & John Ferrell.

But Cornelius made his will and died shortly afterwards himself and Barbary Sr. took on the job of administratrix of Bartholomew's estate. This is the first time that Barbara is referred to as "Sr." to distinguish her from her married daughter Mrs. Barbara Foley. Bridget Foley was Bartholomew and Barbara's youngest daughter:

Patrick Co., VA – 2 Jan 1794
Will of Cornelius Deweese. Wife Dawry. Children William, Bartley, & Mary. Witnesses – Beverage Hughes, Barbary Foley Sr. & Bridget Foley.

Sep 1794 - The court orders Barbara to receive her one-third of Bartholomew's land she inherited automatically when he died without a will:

Patrick County VA court - (26 September 1794)
Charles Foster, John Koger, William Sharp & William Fuson or any 3 of them are appointed to lay of and alot to, Barbury Foley Widow & Relict of Bartholomew Foley Deceased, one third Part of the lands he Died Seized of and Make Report thereof to the Court.

Feb 1795 - Barbara is named along with those who helped put up money for her bond, David Morgan and John Ferrell and her daughters Elizabeth, Mary, Rachel, Barbara Jr., Eleanor "Nellie", and Bridget "Biddy":

Patrick Co., VA court - 27 Feb 1795 - will book 1, p. 10.
"Administration of the estate of Bartholomew Foley dec'd is granted Barberry Foley the widow who qualified according to law with David Morgan, John Ferrell, Elizabeth Deweese, Mary Foley, Rachel Foley, Barberry Foley, Nellie Foley, and Betty Foley [should be "Biddy" Foley] her securities."

9 Dec 1795, Patrick Co., VA – Daughter Rachel Foley m. Richardson Davis. John Ferrell surety.

26 Dec 1796 - Daughter Eleanor "Nellie" sold the land she had inherited from Bartholomew's estate to neighbor Humphrey Smith, who by now was executor of her brother-in-law Cornelius Deweese's estate:

"Relinquishment by Elenor Foley, one of the heirs of Bartley Foley, deceased, and have this day sold to Humphrey Smith all and singular my right, title and interest in and to all the lands and tenements which the said Foley died seized of for value received and do hereby relinquish all claims to his estate.
Dated December 26, 1796. Signed Elenor Foley
Witness David Harbour Sr., Luke Foley, Olevia Smith."

August 30, 1798 - Patrick Co., VA, Order Book 0, p. 200, Patrick Co.
A relinquishmenbt or quit claim from Elinor Foley co-heir of Bartlett Foley dec'd to H. Smith.

The William T. Foley referenced below may be Bartholomew and Barbara Sr.'s oldest grandson, William Deweese, who seems to have used the Foley name (at least occasionally) after his father Cornelius Deweese died. As Bartholomew and Barbara had no surviving sons, he may have done this to continue the family name:

Oct 1802 - Patrick Co., VA deed book 2, Oct 1802 Court, p. 161. Reference to Cornelius Deweese, dec'd. Land survey for transfer of 238 acres witnessed by William T. Foley, Richard Thomas, and others.

Another list of Barbary Sr.'s heirs is given in 1803. Her children had come to an earlier agreement to allow her to remain in the family home without splitting off her dower land, but now they petition the court to divide the land. Again, a second Barbary Foley, her daughter, is listed among the heirs. The daughters are listed in the same order as in the 1795 bond and this was probably their birth order:

Aug 1803 - PATRICK COUNTY, VA - COURT - Order Book "1" (Selected Entries, 1803) AUGUST COURT (25 August 1803)
"An Instrument of Writing from under the hands & Seals of Elisabeth Duweese, Rachel Davis, Mary Foley, Barbary Foley, Nolley Foley & Biddey, relative to the Devision of their lands Presented in Court Proven by the Oath of the witness thereto subscribed & O.R."

"The Widow Foley" referred to below may have been either Mary, widow of Luke, or Barbara Sr., widow of Bartholomew:

NOVEMBER COURT 1805 (28 November 1805)
William Sharp Sr. is appointed Surveyor of the road in the Place of Richard Sharp from the top of the Bull Mountain below the said Sharps Place up to the ford of Sycamore at the Widow foleys, and the list filed be his Gang.
Major Hancock is Appointed Surveyor of the road from the top of the Bull Mountain to the Branch at the lower(?) end of Foleys old Field, & the list filed be his Gang.

1807 - Barbara has become incapacitated in her old age and requests Richard Thomas to administer her affairs. It seems that by this time all of her sons-in-law had either left the area or were otherwise unable to manage the job. She is again referred to as "Sr." to distinguish her from her daughter Mrs. Barbara Foley:

Patrick Co., VA - MAY COURT - (28 May 1807)
"Richard Thomas is at the request of Barbary Foley Sr. appointed to superintend her business she being in some degree deranged, & the said Richard Thomas & David Harbour is hereafter to enter into bond for the faithful administering the estate of the said Barbary Foley Sr. according to law."

1807 - Patrick Co., VA deed with Barbary Jr. and Lity as witnesses for Barbary Sr. [I don't have details of this deed.]

This road survey appears to be referring to Bartholow Foley's land:

1809 Mar - MARCH COURT (28 March 1809) Patrick Co., VA
"Benjamin Mayo is appointed surveyor of the road from the branch in Foley's old field to the top of the bull Mountain in the Place of John A. Hancock & the list filed be his Gang."

May 1809 - both Elizabeth Deweese (the Widow Deweese), daughter of Barbara Sr. and "the Widow Foley" are referenced in this road survey order. The "Widow Foley" was likely Barbara Sr., although it's possible that her daughter Barbara was also widowed by this time.

1809 May - MAY COURT (25 May 1809) Patrick Co., VA
Adam Turner, James Ferrell, John Burnett & W. Rowland or any 3 of them are appointed to view a way to turn the road from the Widow Duweeses to to the top of the hill between Richard Sharp's & Hairston's Store & make report thereof to the Court.
Moses Harbour is Appointed Surveyor of the Road in the Place of James Ferrell from the forks near the Widow Foleys to the forks below Benjamin Mayo's & the list filed be his Gang."

Patrick County Commonwealth's grants or patents:
59 309 David Harbour 26 Jul 1809 55 On both sides of Sycamore Creek, adjoining Ross, Foley, etc.

In 1816, Humphrey Smith either sold or gave the land he had acquired from Eleanor to Barbary Foley. It's not clear if this is Eleanor's mother Barbara Sr. or her sister Barbara Jr., but it seems most likely that Barbara Sr. was deceased by this time:

June 10, 1816, Patrick Co. Deed book 4
"Be it known that I Humphrey Smith of the County of Montgomery did some years ago purchase of Ellenor Foley one of the heirs of Bartley Foley Dec'd her rights and part of in and to her father's estate both real & personal and obtaining her relinquishment there of which was recorded in the county Court of Patrick and do by these present relinquish the same unto Barbary Foley witness my hand and seal this 10th day of June 1816.
Witnessed by James Bartlett and Warren Massey"

Again, the William Foley referenced here appears to have been Bartholomew and Barbara Sr.'s grandson William Deweese:

Deed book 4, p.387, Patrick Co., VA court, Aug 1817, Bartlett Deweese, Elizabeth Deweese, Polly ? Deweese, and Wm. Foley sold land.

Barbara Sr. definitely died by Sep 1829, when the administers of her estate, one of whom was Richard Thomas, paid a debt to the estate of John Burnett:

15 Sep 1829 - Patrick County Virginia
Will Book #2, Page #106
The Estate of John Burnett dec'd
To this amount paid Foley as per receipt.............1.62
By Cash received by the admins of Barbara Foley ......1.50
We the undersigned Commissioners appointed by the County Court of Patrick __ state _____ the account current of Stephen Hubbard and John Turner administrators of John Burnett dec'd with the estate and also ascertain and determine the advancements made by the decedent in his life time to his several Legatees, have performed that duty as far as the accounts have been exhibited to us and find the forgoing to be the result. Given under our hands this 15th day of September 1829 --- all of which is respectfully submitted.

R. Thomas

The other mention of a second Bartlett Foley who was alive at least nine years after Bart Sr.'s death:

SEPTEMBER COURT 1804 - (27 September 1804)
Wm. Sneed & his Gang is to be considered as Oversaer(?) of the New Road from Silas Ratliffs into the __ near Bartlett Foley & it is Ordered that they do clear and keep the same in repair according to law.

Bart Sr. and Barbary Sr. apparently had no surviving son, but their eldest daughter Elizabeth Deweese's son William seems to have assumed the name Foley to carry it on.

********************

Bartlett Foley and Barbara Sr.'s children (all daughters):

1. Elizabeth Foley "Dawry", b.c. 1758, VA?; m.c. 1775-80, probably Henry (now Patrick) Co., VA to Cornelius Deweese [b. 22 Mar 1731, Abbington, Philadelphia County, PA; d. 1794, Patrick Co., VA; son of Garrett Deweese and Mary]; she d. after May 1809, probably after Aug 1817, Patrick Co., VA.

She was Cornelius's second wife.

1793 - Cornelius was appointed as one of the administrators of Bartholomew's estate.

Jan 1794 - Cornelius wrote his will and referred to Elizabeth as "Dawry":

Will Book 1, pg 25 2 Jan 1794
Will of Cornelius Deweese
All of the estate to be sold, deducting the wife's part. Wife: Dawry Deweese. Money to be equally divided amongst the children: William Deweese, Bartley Deweese and Mary Deweese. The two boys to be put to trade at the discretion of the executor. Executor: My beloved friend Humphrey Smith
Witness: Beverage Hughes, Barbary Foley, Sr, and Bridget Foley.
Returned May Ct 1794

Elizabeth sons William and Bartlett were ordered by the county court to be "bound out" as apprentices to learn trades, as had been requested by their father in his will, after Humphrey Smith, the will's executor, failed to act:

Patrick Co. VA Court Order Bk "O", p 79; Court Friday 26 Sept 1794:
--Ordered that the poor orphans of Cornelius Deweese be bound out by the Overseers of the Poor.

Son William apparently assumed the name Foley after his father's death. His mother may have encouraged him to do so, as her father Bartlett Sr. apparently had no surviving son and Cornelius had sons from a previous marriage in addition to Bartlett by Elizabeth.

Elizabeth appears to be still living in 1817 when she and her children sold land. It's possible the Elizabeth listed was Bartlett's wife, if he was married:

Aug 1817 Court, Patrick Co., VA, deed book 4, p. 387. Bartlett Deweese, Elizabeth Deweese, Polly Deweese, and William Foley sold land.

Elizabeth Foley's children:

1) William Deweese Foley, b.c. 1780, Henry (now Patrick) Co., VA;

As Cornelius suggested in his will that William and his younger brother Bartlett be bound out to learn a trade, I'm guessing William was at least about fourteen years old in 1794. This age would seem to tally with the ages of Cornelius's children from his first marriage.

He may have taken the name Foley after his father's death.

This William T. Foley seems to have been William Deweese:

Patrick Co., VA deed book 2, Oct 1802 Court, p. 161. Reference to Cornelius Deweese, dec'd. Land survey for transfer of 238 acres witnessed by William T. Foley, Richard Thomas, and others.

1810 - William wasn't on the Patrick Co., VA tax list as either Deweese or Foley.

This appears to be him again selling land along with his brother, mother, and sister:

Aug 1817 Court, Patrick Co., VA, deed book 4, p. 387. Bartlett Deweese, Elizabeth Deweese, Polly Deweese, and William Foley sold land.

This 1820 census page is faded and hard to read, but this entry may be for William Foley

3) Bartlett Deweese; , b.c. 1782, Henry (now Patrick) Co., VA; d. 1840?, Patrick Co., VA?

He was listed on the 1810 Patrick Co., VA tax list with one white tithable (himself), no slaves and no horses. He may have had a wife and children:

2. Mary Foley, b.c. 1760, VA?; apparently unmarried as of 1803 and living in Patrick Co., VA. If she was married by that time, she had married another Foley; she d. after Aug 1803, Patrick or Franklin Co., VA.

27 Feb 1795 Friday, Patrick Co., VA, p. 90

Rachel was widowed by 1820; probably by about 1805.

Possible grandchildren of Bartholomew and Barbara were Gabriel Foley Bowling and his sister Arminta Foley Bowling, apparently children of James Bowling by an unmarried daughter of either Bartholomew and Barbara Foley or of Luke and Mary Foley:

i. Gabriel Foley Bolling, b. 1789; registered his marriage 1st 19 Nov 1813 as Gabriel Foley and again on 14 Dec 1813 as Gabriel Bolling, Patrick Co., VA, both times to Elizabeth Tuggle; m. 2nd 15 Oct 1849, Franklin Co., VA to Katherine Sally LESUER [b. 8 Apr 1800, VA; d. 1870-1880, Floyd Co., VA; daughter of Martel Lesuer and Elizabeth Bacon]; he d. 1868, Floyd Co., VA.

Patrick Co., VA deed book 1, p. 578, 30 Nov 1798.
"James Bolin grants to Gabriel Foley and Arteminey Foley several items including food, bed and pig."

Gabriel Foley was listed on the 1809 Patrick Co., VA tax list as Gabriel Bolling:

1809 Patrick Co.
Left to right: Free tithes - Blacks over 16 - Blacks over 12 & under 16 - Horses
Gabriel Bolling 1 - 0 - 0 - 1

In 1810, Gabriel was again listed a Foley, he and his brother Christopher were the only two Foleys on the list that year:

*******************

Henry County Commonwealth's grants or patents:

8. Luke Foley
27. William Bolling (disputed)

44. Bartlett Foley
65. Joseph Bolling
74. Thomas Richardson
115. Warham Easley
119. Thomas Harbour
128. Francis Turner
150. John Ferrell

18 Apr 1788, Henry (not yet Patrick) Co., VA - Bartholomew and Barbara sell land. Barbara is not referred to in this document as "Sr.", indicating probably that her daughter Barbara isn't yet married to her cousin Jeremiah Foley:

LAND GRANTS OF HENRY COUNTY, VA.: (deed abstracts-DB=Deed Book)

In 1790, Bartholomew was taxed for three head of cattle, but not for himself, indicating that he was either too old or too disabled to be taxable. He is listed next to John Ferrell:

1790 Henry Co., VA personal tax list, pg 6.
[the only Foley listed]
Bartholomew Foley 0 white tithables over 16 [Bart Sr. too old or sick to be taxable]

A. Staples
J. Tatum

1) William Deweese Foley, b.c. 1780, Henry (now Patrick) Co., VA;

2) Mary Deweese, b.c. 1782, Henry (now Patrick) Co., VA.

She was still unmarried in Aug 1817:

Patrick Co., VA deed book 4, Aug 1817 Court, p. 387. Bartlett Deweese, Elizabeth Deweese, Polly Deweese, and William Foley sold land.

It's possible she was the Mary Foalley on the 1810 census in neighboring Franklin Co.,VA. If this is her, she appears to be a widow with children:
