He was included in September 1848 on the muster roll of the newly formed Walton County Volunteer Rifle Company, Commanded by Captain Elijah Palmer and attached to the 42nd Regiment, Georgia State Militia. He was living with his family in Walton County in 1850, and in Morgan County in 1860. He enlisted on 9 May 1862 (at age 39) as a Private in Company I, 44th Regiment, Georgia Volunteer infantry, Army of Northern Virginia, CSA, identified as the "Henry/Morgan County Volunteers."
He was captured at Spotsylvania, Virginia on 10 May 1864 and paroled in February 1865 at Ft. Delaware, Delaware, received at the James River, Virginia wharf for exchange on 10 or 12 March 1865, and died (at age 42) on a steamship enroute home, and he was buried at Aiken's Landing, James River Virginia, thus leaving a widow with ten children ranging in ages from 22 to 5.
His widow Margaret Brooks was living with her remaining at-home children (including her married oldest son William) in 1870, when the family unit was enumerated in both the Morgan County and Jasper County Census records, indicating they lived somewhere near the junction of those two counties.
