Benjamin Peyton Ashby was born 30 April 1810 in Clarke County, Virginia. This information comes from the Bible which was his and his daughter's. His parents were reputedly named Peyton (Dayton) Ashby and Elsie Corder. This information has not been verified. He was married to Mary Ann Keller on 29 January 1840 in Frederick County, Virginia, with bond being provided by Jacob Keller, presumably Mary Ann Keller's father. The marriage is recorded in the Clerk's office of the Circuit Court in Frederick County in the Marriage Register Book No. 1, page 8, line 12.

By 1844, Benjamin and Mary Ann were living in St. Charles County, Missouri. There, their daughter, Catherine Elizabeth Ashby was born on 30 January 1844.
