Mr. Allen had been at the Stockton State Hospital 4 months and 14 days at the time of his death. He was a seaman who was born in Maine. He had been in California for 25 years. According to Dr. H. E. Landerson, Mr. Allen died of a "cerebral hemorrhage." Mr. Allen was buried in the Stockton Rural Cemetery on 21 Apr 1911.

About two weeks before the court was asked to intervene, Mr. Allen wandered about aimlessly, was not taking care of his grooming, refused to eat, and wanted his life to end. The doctors determined he needed care at a state hospital. On 5 Dec 1910, Judge Norstrand ordered Mr. Allen to be taken to the Stockton State Hospital for treatment. Herbert Allen, living at 438 Hayes Street in San Francisco, was Gilbert Allen's closest relative. The admitting diagnosis was "organic cerebral disease." Mr. Allen died on 19 Apr 1911 of "cerebral hemorrhage."
