Insufficient To Warrant Being Held.
"The preliminary examination of Frank Trabucco Jr., who was charged with the killing of Thomas Baxter in Mt. Bullion on the 10th inst. was held in that town on Monday the 23rd. The prosecution was represented by District Attorney J. A. Adair and R. B. Stolder assisted by John A. Wall conducted the defense. Lee Rowland of Mariposa was the short band chronicler of the evidence, and although this was his first case of court reporting, he proved equal to the task and very creditably reported the evidence in the case. Six witnesses were examined, to-wit: Fred Margrave, J. R. Noble, F. T. Maguire, Louis Marie, Johnny Ham and James Tresidder. The case was then submitted and the court, basing its judgment upon the evidence adduced at the examination, which showed that the shot which caused the death of Thomas Baxter, was not accidentally fired, was discharged by defendant under the apprehension that he, the defendant, was in imminent danger of receiving great bodily injury at the hands of the deceased at the time, and in any event was innocent of the charge preferred. The testimony showed that only one shot was fired, and the bullet before entering the body of the deceased passed through the left hand of the defendant. Judge Scott's decision was right as the evidence produced by the prosecution in this case was entirely inadequate to warrant a conviction before a jury in the Superior Court. Too many cases have been brought to the Superior Court that should have been dismissed at the preliminary hearing of the accused and we think that the tax-paying population of Mariposa county is to be congratulated in saving the useless expense of from $2000 to $1000 when a conviction would be impossible, and this decision as a consequence finds approval among the many who heard the evidence in the case."
