Well-Known Member of District Bar Victim of Consumption
Theodore W. Birney, a well-known young member of the District bar, died at the residence of his brother, ex-District Attorney Arthur A. Birney, No. 1516 Florida Avenue, at 3 o'clock this morning, of consumption, in the thirty-fifth year of his age. His funeral will take place from his brother's residence at 4:30 o'clock Monday afternoon and the interment will be made in Oak Hill Cemetery. During a fishing and hunting trip last September Mr. Birney contracted a severe cold, which developed into consumption. Early last December he went to Arizona and in March to California, in the hope of recovering his health. He improved for a time, but then gradually grew worse, returning to Washington early last month. It was then seen that he was hopelessly ill and that his death was a question of but a short time. Mr. Birney was the son of General William Birney, a well-known citizen and also a prominent member of the District bar and was born near Morris, Illinois, May 6, 1863. He graduated from Leigh University and from the Georgetown law School about ten years ago, taking the essay prizes each year of his course at the law school. He went to Atlanta, Georgia, practicing law there until his brother was in 1893 appointed United Stated District Attorney for the District of Columbia, when he returned to this city and associated himself with him in the practice of law. He married in Atlanta and leaves a widow and two children [Catherine Birney born October 11, 1893 who married Baron Wilhelm Von Schoen in 1916; renounced her title and was readmitted to citizenship in 1946; died under name Catherine Schoen in 1985], Mrs. Birney being the founder of the mothers' congress which met here last February. Mr. Birney was a young man of great personal popularity, highly esteemed and had already attained great prominence in his profession.
