THE WILL OF JOHN GRAY*
OF KINGSTON, MASS.

[From original will] On 23 September, 1728, "John Gray of Kingston" made his will. Bequests were as follows:

To "wife Johannah Gray during her natural life the use Improvement & Income of all my Lands whatsoever which I have not already disposed of by deed of Gift with So much of my buildings thereon as she Shall have ocation to make use of for her Comfortable accomodation" also "my best Bed & furniture Suitable for it."

To "my Son Samuel Gray over and above what I have already given him by deed of Gift (which I do hereby Confirm to him) all my Lands meadows & buildings & all & singuler my real estate .... not heretofore disposed of by deed of Gift; To him the sd Samuel Gray .... after the decease of my wife Johannah Gray" also "all my wearing Clothes my Gun & Sword, a Silver spoon, a bed & Furniture, (which he hath already in possession) Together with what is due to me by bond from my Son in Law John Tincom Hereby ordering him to pay to my daughter Marcy the Sum of Thirty pounds in mony or bills of Credit. & further it is my will that my Said Son Samuel allow to my daughters Johanah Fuller & marcy Gray .... the Privilidge of Passing over the Land which I have given him to and from the Land which I have given them Respectively where it Shall be most Convenient through Gates or Barrs which privilidge I have given to my Said daughters by deed."

To "my abovesaid wife during her natural Life One quarter part of the Hay which Shall be Cutt by my Son Samuel on the Salt meadow & Sedge ground I have given him Lying on Smelt River"

To "my daughter Marcy Gray over and above what I have already given her by Deed (which I do hereby Confirm) a Bed Bolster bedstead; a Suit of Curtains, Two pair of sheets a pair of Blankits Blankits Two Curtains Two Pillows & Curtain Rods; Also Two Cows a Chest of Draws Two Black Chairs, Six Common Chairs a pair of Tongs & fire slice, a Spit, a Trammel, a Small Iron kettle, an Iron Skillit & a Silver spoon."

"I give and bequeath all the Remainder of my personal Estate as followeth viz One Third part thereof to my aforesd wife for ever One Third part thereof to be equally divided among my three daughters viz Anne Tincom Johanah Fuller & Marcy Gray .... and all the Remainder thereof .... to my Son Samuel Gray Together with my Pew below in the meeting house in Kingston . & . . . . my Pew in the Gallery in Said meeting house Shall be Improved by the Children of my three daughters viz Such of them as shall Live in this Town from Time to time"

"Son Samuel Gray" was appointed sole executor, and required to pay the debts and funeral charges out of the part of the estate left to him.

The witnesses were Thomas Croade, David Sturtevant and Jonathan Sturtevant. Thomas Croade and David Sturtevant made oath to the will, on 4 July, 1732, and Jonathan Sturtevant on 21 July, 1732, all before Isaac Winslow, Judge of Probate.

The will was probated, at Marshfield, 21 July, 1732, and administration granted to "Samuell Gray the onely son of the sd deceased and sole Executor in the same Will named" [The will and letter were also recorded, 6 : 191]

[From original warrant] On 4 July, 1732, "mr Samuell Foster mr Josepth Mitchell & mr Seth Chipman all of Kingston" were appointed to appraise the estate. [The warrant was also recorded, 6:215.]

[From original inventory] The inventory was taken, at Kingston, 7 August, 1732, by the three appraisers. The real estate was "The Housen and Land That was Shown to us By ye Executor" £350. The personal estate was valued at £211, is., 4d. Samuel Gray, the executor, and the three appraisers, made oath to the inventory, 8 August, 1732. [The inventory was also recorded, 6:215.]

[7 = 427] On 23 August, 1738, "We Joanna Gray (Widow of mr John Gray late of Kingston .... Deceasd) Ebenezer Fuller & Joanna Fuller his Wife, Jabez Fuller & Mercy Fuller his Wife all of Kingston .... The sd Joanna & Mercy Fuller being also Daughters of ye sd John Gray deceasd .... Discharge & acquit Samuel Gray of Kingston aforesd only Son of the sd John Gray, & sole Executor to his last Will & Testament of all Dues Claims or Demands whatsoever on account of any Legacies, Bequests Houshold Stuff or Goods whatsoever (Saving y"5 Priviledges & Improvemts of Land or Buildings granted to ye sd Widow & ye sd

two Daughters in & by ye sd Last Will Hereby acknowledging

.... the Receipt of ye personal Estate granted Severally to us in ye sd Will". The witnesses were John Cole, Jr., and Rebecca Drew. The discharge was signed by Joanna Gray (by a mark), Ebenezer Fuller, Joanna Fuller (by a mark), Jabez Fuller and Mercy Fuller, and was acknowledged by all, on the day of its date, before Josiah Cotton, Justice of the Peace.
