Criminal Folk Figure. Ellena (Ellie) Starr Nesler made world headlines in April, 1993, when she shot and killed her son's accused molester, Daniel Driver, in the Jamestown, California, courtroom during a break in the man's trial. Driver had been accused of molesting four boys including Nesler's son. Already upset by her son's requirement to testify, Nesler became more upset when Driver smirked at her son while being lead by police just a few feet past the boy and into the courtroom. Nesler verbally threatened Driver in retaliation but quickly resumed taking care of her son who had been continuously vomiting in nervous anticipation of testifying. Nesler asked her sister if she had any Tums, an antacid, and saw the gun when her sister opened her purse to check. Less than five minutes later, Nesler sneaked the gun from her sister's purse and shot Driver in the head five times as he sat shackled in the courtroom. While free on bail, Nesler made several television appearances including on "The Maury Povich Show" in which she revealed a secret that she kept from everyone including her sisters, that she had been molested as a child. Nesler was found guilty in 1994 of voluntary manslaughter and served three years of a 10-year sentence. A juror had been dismissed late in Nesler's trial for repeating rumors to the other jury members about Nesler's fitness as a mother. Nesler was released after an appeal based on that juror's misconduct. While awaiting trial in 1994, Nesler was diagnosed with breast cancer. She passed away in Sacramento, California on December 26, 2008. Nesler won both worldwide support and criticism for taking matters into her own hands when she killed Driver. The case became a 1999 TV movie, "Judgment Day: The Ellie Nesler Story." Her story was also featured in tabloids and in Redbook magazine. (bio by: P. L. Mohr)
