The Richmond Enquirer has Joseph "died 25 Oct 1820, at 69 years old", so he was born between 26 Oct 1750 - 25 Oct 1751, in Goochland County, Virginia, to John Haden and Jean Moseley. Joseph 1st married MARY PEATROSS - d/o Matthew Peatross & Amey Bram(e). Mary died before 1815, since Joseph was married to JANE TURNER by then. Joseph's marriage to Mary was not recorded by Rev. William Douglas, but their child John Nelson, was noted as born 30 Apr 1774, so Joseph and Mary were likely married 1772/3. Joseph is occasionally misinterpreted as his uncle, who died in 1803, in North Carolina, who 1st married Elizabeth Hundley and 2nd married Margaret Maxwell.

Shortly after citizens decided to separate from south eastern Albemarle County and form Fluvanna County in 1777, Joseph was appointed Justice of Peace by Governor Patrick Henry. During the Revolution, Joseph served with his brothers Anthony the younger, William and John, as members of the Fluvanna Militia. Capt. Joseph Haden, with his brother Capt. Anthony Haden, were said to have been at the Siege of Yorktown in the Fall of 1781, commanded by their cousin Colonel Charles Dabney, when British Commander General Charles Cornwallis surrendered. After the war, Joseph became a state tobacco inspector at Bernardsburg, where he was a founder and trustee. In 1788, he was chosen as a delegate to the Virginia convention to ratify the U.S. Constitution. Joseph was elected to represent Fluvanna Co. for ten terms in the Virginia House of Delegates - Thirteenth Annual Report of the Library Board of the Virginia State Library (1917) pgs. 41, 44, 48, 60, 62, 276, 382.

7 Aug 1777, when Joseph was 26, he was gifted his father's 650 acre plantation home where he had already been living, on the northern branches of Byrd Creek in newly formed Fluvanna County, near the border of Goochland County. From his father's original deeds these lands were described as being on one or more branches of Byrd Creek, known then as "Elk Run or River" - a description no longer used and not to be confused with Elk Creek on Elk Island on the James River. This was likely Joseph's father's last plantation before moing to Dogspoint in 1764/7, and was likely a part of the land his grandfather - Anthony the elder, had passed down to Joseph's father.

The 1820 census notes Joseph's household with 38 slaves. After he died, his son John Nelson, filed a land division suit in Fluvanna Co., where the court relied upon 4 survey maps totaling 1320.25 acres, constructed by surveyor - Peter H[enry] Ware. The surveys show Joseph's lands were on both sides of Byrd Creek and to the east, on both sides of Horsepen Creek at the Goochland Co. border, which also included land between Byrd and Horsepen Creeks on both sides of White Hall Road, that was then known as Elk Run/River. Joseph also held land at the junction of Charlottesville Rd & Union Mills Rd.

The following deed abstracts indicate Edmund Lilley's sons as Joseph Haden's neighbors in 1777, as was Edmund Lilley in 1759, when Joseph's father bought the tracts. Edmund's land was described as being partly in Goochland, partly in Albemarle - now Fluvanna, just as John's 1759 and 1762 transactions appear. Also in Joseph's land survey report, the Clark(e) tract is mentioned several times, this line being the same one described when Joseph's father bought the Elk Run/River tracts where "John Clark(e)" was referenced in the following deed abstracts.

Joseph Tate was living in Roane Co NC in 1759 and lived near John's brothers - William & Joseph Haden, in North Carolina. Haden Tate & Jouett families had land transactions and/or marital ties in Virginia, North Carolina and Kentucky.

★ 4 Sep 1777: With the Fluvanna Militia, he took oath as Captain. The 18 Oct 1833 Revolutionary War Pension Application of DANIEL THACKER of Fluvanna Co VA, mentions "he marched from Fluvanna to Hillsborough, North Carolina, in a company under the command of JOSEPH HADEN, and then In 1781, he joined a company under CAPT. ANTHONY HADEN (Joseph's brother) from Fluvanna, marching through the lower part of Virginia pursuing the enemy through the counties of Culpeper, Orange, Louisa & Fluvanna and to Yorktown, returning to Richmond where he was discharged. Colonel Charles Dabney commanded the detachment.

★ Sep 1784: Fluvanna County Court clerk recorded ..."JOSEPH HADEN, JOHN NAPIER and SACKVILLE KING Gentlemen are appointed to collect and ascertain the Various Losses and Injuries both public and private which have been sustained within this County during the late War, from the Depredations of the enemy, in the Several Invasions, and State the same under so many different heads as such losses or Injuries may consist of and Return the same together with the proofs made in support thereof, to the Governor and Council."

Sackville King had bought the Cuckoo Tavern in Louisa Co. from John Jouett Sr., father of Jack Jouett, whose daughter Elizabeth married William Dabney Haden → son of Anthony Haden → brother of Joseph. A few years after the war ended, Sackville King also moved to Campbell Co. Virginia, where he was the founder of Kingston, a small hamlet a few miles from where Joseph's brothers Anthony and Benjamin, and father John had settled on/near the Otter River ca. 1785.

★ 2 - 27 Jun 1788: JOSEPH HADEN was selected to represent Fluvanna County as 1 of 170 delegates to attend the Virginia Convention, on the question to ratify the Federal Constitution. Joseph's votes were aligned with Patrick Henry's Anti-Federalists (The Debates in the Several State Conventions of the Adoption of the Federal Constitution, vol 3 Virginia, by Jonathan Elliot-1827).

★ 3 May 1792: At a Court held for Fluvanna County on Thursday. Present, the Justices of the sd County, to wit: John Ware, JOHN NAPIER, JOHN THOMPSON, WILLIAM OGLERLY, DUNCAN McLAUGHLIN, JAMES PAYNE, Gentlemen. This Court doth nominate to his Excellency the Governor, JOSEPH HADEN, Gent., as a proper person to execute the office of a Major in the militia of this County. A copy: JOHN TIMBERLAKE, C.F.C.

★ 20 May 1792, from Joseph Haden to:
Sir, COL. HALL will hand you the recommendation from the Court of Fluvanna for a Major of the Militia. I am informed Captain William Paine has already furnished you with the same, with objections to my being commissioned. I am not acquainted with the objections he makes, but have been informed one is on account of being Inspector at Rivanna. Its true I am, but that don't clear me of the Militia only in time of peace, but am subject to the Militia Laws in case of an invasion &c. Therefore I consider myself as one of the Militia. Another I suppose is informing you he is the oldest Capt'n, &c. For this I refer to COL. TUNSTALL QUARLES, who is now in Richmond. I was a Capt of the Militia in the County of Albemarle before the division of the County took place & after the division was commissioned in Fluvanna & performed my duty through the whole of the last war as a Captain. When there Was Commissioners appointed agreeable to an Act of Assembly for recommending Officers, I was again commissioned, which I resigned a few years past. In fact, I am the oldest officer in the County. In another instance it may probably have been signified to you that there was not a full Court at the time I was recommended. The truth of that is I was recommended without any solicitation. There is only Nine acting Magistrates in the County, & six of them present. There was not a dissenting voice amongst them & no other person proposed, the Magistrates present were also the senior Magistrates in the County. For the truth of my assertions I refer you to COL. T.[UNSTALL] QUARLES, and also I refer to him and Mr. DAVID ROSS. Respecting the whole matter, my general conduct & fitness to fill the office to which I stand recommended, & upon getting fully acquainted with the matter from them, I doubt not but you'll forward me a commission by Colo. ★May 26, 1792: DAVID ROSS to the Governor Henry Lee III of Virginia; Richmond,
Sir, I am informed that CAPT. JOS.[EPH] HADEN of the County of Fluvanna has referred to me for information relative to his appointment as a militia officer. I believe he has been a Capt. in the Militia since the first establishment of the county of Fluvanna & long before it was separated from Albemarle [1777]. Some years ago, I was app'd one of the commissioners to nominate proper persons to the Executive as Militia officers for that county. The Commissioners were unanimous in recommending Mr. Haden as a proper person for Captain; I had then & still have, full conviction in my mind that he's as well qualified for the duties of a Militia officer as most men in the county.

It can be construed accurately that Joseph did not receive his appointment as Major to the Fluvanna Militia, since his land division court file references him as "Captain".

★ Nov 1794 - Feb 1804: represented Fluvanna Co. in the VA House of Delegates for 9 straight terms/sessions. ★ Nov 1796 - Laws passed by the Virginia Legislature:
" # 12) That twenty-five acres of land, the property of ALLEN BERNARD, on the Rivanna River, in the county of Fluvanna, shall be, and they are hereby invested in JOSEPH HADEN, ROBERT QUARLES, JAMES PAYNE, JOHN WELLS, HENRY MARTIN, JOSEPH BERNARD, JAMES CREWDSON and PETER H. WARE, gentleman, trustees, to be by them, or a majority of them, laid off into lots of half an acre each, with convenient streets, and established a town by the name of Bernardsburg." The Statutes at Large of Virginia; from October Session 1792, to December 1806, Vol II. Note: Peter H. Ware was the surveyor who produced an inventory of Joseph's lands when they were divided up amongst his heirs after his death.

This is where Joseph was an 'inspector' at one of the earliest warehouses for the state inspection of tobacco, located at Bernardsburg, aka Bamesburg or Crofton.

★ 23 Jan 1800: friends of Thomas Jefferson met in Richmond to decide on a course of how best to elect their candidate in the presidential election to be held in November.....county committees were formed and from Fluvanna County, included JOSEPH HADEN as a member. Joseph's father John, had property on Cunningham's Creek bordering one of Jefferson's tracts. Prior to Jefferson becoming Governor of Virginia, TJ also represented Joseph's father John, Uncle Zachariah, and brother Anthony in the courts, usually pertaining to land or labor. While Thomas Jefferson was Vice President under John Adams, as he was preparing to run for President, he hired "John Haden" to escort an Indian Delegation through "Albemarle County" Virginia. This likely was Joseph's brother, John Moseley Haden, based upon the numerous prior Haden relationships with Thomas Jefferson AND the fact that Joseph being a member of the Virginia House of Delegates, had the availability and means to be a liaison in communication with both.

*** 42 SLAVES was even for those days, a large number indicating the likelihood that Joseph who often went to Richmond, engaged in the buying and selling of slaves. The U.S. abolished the importation of slaves, in 1808.

★ Dec 1819-Feb 1820: represented Fluvanna Co. in Virginia House for a 10th - final term.

★ 9 Oct 1820 - will dated and 27 Nov 1820 - will probated, which made specific bequests to daughter POLLY MARTIN, grandson ROBERT H. T. STRATTON, SAMUEL D. & MATILDA RICE children of dau JOANNA RICE, grandson JOSEPH T. HADEN, friend THOMAS HUGHES and others. The balance of the estate was to be divided into 9 parts to his children or their heirs. The book "John Haden of Virginia" lists Joseph's heirs as of 1835, in connection with the settlement of his estate:

William "P." Haden - listed as an executor, should be WILLIAM TRIGG HADEN, son of Joseph's oldest son Matthew. Other executors: JOHN N. HADEN and MATTHEW H. RICE.

Died on October 25, in the 69th year of his age, Capt. Joseph Haden of Fluvanna County, a soldier in the Revolution, a member of the Virginia Convention and for many years represented his County in the state legislature.

Like his brother John Mosely, Joseph remained in Fluvanna County until he died.

By 1815, Joseph Haden had remarried to Jane Turner, since a court record from that year shows they brought suit in Fluvanna County Chancery upon William Cunningham and his wife Mary, for a debt to be paid. Since Jane is not mentioned in Joseph's land division case/settlement, its likely Jane died before Joseph.

The court file pertaining to the division of Joseph's estate after his death, contains four different plat survey maps, split into lots for his 9 descendant children's legacies and friend Mr. Hughes. The lot/plat descriptions also include his home, half acre family cemetery - marked with 4 corner stones and 1300 plus acres (2 sq miles) with metes, bounds, poles, on Byrd Crk, Horsepen Crk, and Elk Run by Whitehall Road → todays' Byrd Creek East Branch. A compendium of the aforementioned lands is as follows . . . . .

In the obedience to the order and decree of the Worshipful Court for thew County of Fluvanna, we the subscribers hereto named in said order and decree as commissioners to divide equally the lands or Real Estate of Joseph Haden deceased we have proceeded with the assistance of Peter Ware, Esq. Surveyor for Fluvanna County to divide the said lands or real estate as in hereafter describe the plats of said lands will accompany this our Report and the dividing lines the number of each lot and part of lot as in hereafter designated that is to say,

Lot No 1 includes the Mansion house of said Joseph Haden deceased containing by survey Twenty acres and a half. This Lot consisting of the Burial Ground containing a half acre and designated by stones at each corner planted for that purpose. There is also added to this lot the one half of the land lying on the north side of the White Hall Road designated in the plat and numbered 1. It being part of the tract called and known by Crank's Tract lot drawn for the Representatives of Joseph Haden JR. deceased.

The Richmond Enquirer has Joseph "died 25 Oct 1820, at 69 years old", so he was born between 26 Oct 1750 - 25 Oct 1751, in Goochland County, Virginia, to John Haden and Jean Moseley. Joseph 1st married MARY PEATROSS - d/o Matthew Peatross & Amey Bram(e). Mary died before 1815, since Joseph was married to JANE TURNER by then. Joseph's marriage to Mary was not recorded by Rev. William Douglas, but their child John Nelson, was noted as born 30 Apr 1774, so Joseph and Mary were likely married 1772/3. Joseph is occasionally misinterpreted as his uncle, who died in 1803, in North Carolina, who 1st married Elizabeth Hundley and 2nd married Margaret Maxwell.

Shortly after citizens decided to separate from south eastern Albemarle County and form Fluvanna County in 1777, Joseph was appointed Justice of Peace by Governor Patrick Henry. During the Revolution, Joseph served with his brothers Anthony the younger, William and John, as members of the Fluvanna Militia. Capt. Joseph Haden, with his brother Capt. Anthony Haden, were said to have been at the Siege of Yorktown in the Fall of 1781, commanded by their cousin Colonel Charles Dabney, when British Commander General Charles Cornwallis surrendered. After the war, Joseph became a state tobacco inspector at Bernardsburg, where he was a founder and trustee. In 1788, he was chosen as a delegate to the Virginia convention to ratify the U.S. Constitution. Joseph was elected to represent Fluvanna Co. for ten terms in the Virginia House of Delegates - Thirteenth Annual Report of the Library Board of the Virginia State Library (1917) pgs. 41, 44, 48, 60, 62, 276, 382.

7 Aug 1777, when Joseph was 26, he was gifted his father's 650 acre plantation home where he had already been living, on the northern branches of Byrd Creek in newly formed Fluvanna County, near the border of Goochland County. From his father's original deeds these lands were described as being on one or more branches of Byrd Creek, known then as "Elk Run or River" - a description no longer used and not to be confused with Elk Creek on Elk Island on the James River. This was likely Joseph's father's last plantation before moing to Dogspoint in 1764/7, and was likely a part of the land his grandfather - Anthony the elder, had passed down to Joseph's father.

The 1820 census notes Joseph's household with 38 slaves. After he died, his son John Nelson, filed a land division suit in Fluvanna Co., where the court relied upon 4 survey maps totaling 1320.25 acres, constructed by surveyor - Peter H[enry] Ware. The surveys show Joseph's lands were on both sides of Byrd Creek and to the east, on both sides of Horsepen Creek at the Goochland Co. border, which also included land between Byrd and Horsepen Creeks on both sides of White Hall Road, that was then known as Elk Run/River. Joseph also held land at the junction of Charlottesville Rd & Union Mills Rd.

The following deed abstracts indicate Edmund Lilley's sons as Joseph Haden's neighbors in 1777, as was Edmund Lilley in 1759, when Joseph's father bought the tracts. Edmund's land was described as being partly in Goochland, partly in Albemarle - now Fluvanna, just as John's 1759 and 1762 transactions appear. Also in Joseph's land survey report, the Clark(e) tract is mentioned several times, this line being the same one described when Joseph's father bought the Elk Run/River tracts where "John Clark(e)" was referenced in the following deed abstracts.

Joseph Tate was living in Roane Co NC in 1759 and lived near John's brothers - William & Joseph Haden, in North Carolina. Haden Tate & Jouett families had land transactions and/or marital ties in Virginia, North Carolina and Kentucky.

The 18 Oct 1833 Revolutionary War Pension Application of DANIEL THACKER of Fluvanna Co VA, mentions "he marched from Fluvanna to Hillsborough, North Carolina, in a company under the command of JOSEPH HADEN, and then In 1781, he joined a company under CAPT. ANTHONY HADEN (Joseph's brother) from Fluvanna, marching through the lower part of Virginia pursuing the enemy through the counties of Culpeper, Orange, Louisa & Fluvanna and to Yorktown, returning to Richmond where he was discharged. Colonel Charles Dabney commanded the detachment.

Sackville King had bought the Cuckoo Tavern in Louisa Co. from John Jouett Sr., father of Jack Jouett, whose daughter Elizabeth married William Dabney Haden → son of Anthony Haden → brother of Joseph. A few years after the war ended, Sackville King also moved to Campbell Co. Virginia, where he was the founder of Kingston, a small hamlet a few miles from where Joseph's brothers Anthony and Benjamin, and father John had settled on/near the Otter River ca. 1785.

★ 2 - 27 Jun 1788: JOSEPH HADEN was selected to represent Fluvanna County as 1 of 170 delegates to attend the Virginia Convention, on the question to ratify the Federal Constitution. Joseph's votes were aligned with Patrick Henry's Anti-Federalists (The Debates in the Several State Conventions of the Adoption of the Federal Constitution, vol 3 Virginia, by Jonathan Elliot-1827).

★ 3 May 1792: At a Court held for Fluvanna County on Thursday. Present, the Justices of the sd County, to wit: John Ware, JOHN NAPIER, JOHN THOMPSON, WILLIAM OGLERLY, DUNCAN McLAUGHLIN, JAMES PAYNE, Gentlemen. Sir, COL. HALL will hand you the recommendation from the Court of Fluvanna for a Major of the Militia. I am informed Captain William Paine has already furnished you with the same, with objections to my being commissioned. I am not acquainted with the objections he makes, but have been informed one is on account of being Inspector at Rivanna. Its true I am, but that don't clear me of the Militia only in time of peace, but am subject to the Militia Laws in case of an invasion &c. Therefore I consider myself as one of the Militia. Another I suppose is informing you he is the oldest Capt'n, &c. For this I refer to COL. TUNSTALL QUARLES, who is now in Richmond. I was a Capt of the Militia in the County of Albemarle before the division of the County took place & after the division was commissioned in Fluvanna & performed my duty through the whole of the last war as a Captain. When there Was Commissioners appointed agreeable to an Act of Assembly for recommending Officers, I was again commissioned, which I resigned a few years past. In fact, I am the oldest officer in the County. In another instance it may probably have been signified to you that there was not a full Court at the time I was recommended. The truth of that is I was recommended without any solicitation. There is only Nine acting Magistrates in the County, & six of them present. There was not a dissenting voice amongst them & no other person proposed, the Magistrates present were also the senior Magistrates in the County. For the truth of my assertions I refer you to COL. T.[UNSTALL] QUARLES, and also I refer to him and Mr. DAVID ROSS. Sir, I am informed that CAPT. JOS.[EPH] HADEN of the County of Fluvanna has referred to me for information relative to his appointment as a militia officer. I believe he has been a Capt. in the Militia since the first establishment of the county of Fluvanna & long before it was separated from Albemarle [1777]. Some years ago, I was app'd one of the commissioners to nominate proper persons to the Executive as Militia officers for that county. The Commissioners were unanimous in recommending Mr. Haden as a proper person for Captain; I had then & still have, full conviction in my mind that he's as well qualified for the duties of a Militia officer as most men in the county.

It can be construed accurately that Joseph did not receive his appointment as Major to the Fluvanna Militia, since his land division court file references him as "Captain".

" # 12) That twenty-five acres of land, the property of ALLEN BERNARD, on the Rivanna River, in the county of Fluvanna, shall be, and they are hereby invested in JOSEPH HADEN, ROBERT QUARLES, JAMES PAYNE, JOHN WELLS, HENRY MARTIN, JOSEPH BERNARD, JAMES CREWDSON and PETER H. WARE, gentleman, trustees, to be by them, or a majority of them, laid off into lots of half an acre each, with convenient streets, and established a town by the name of Bernardsburg." The Statutes at Large of Virginia; from October Session 1792, to December 1806, Vol II. Note: Peter H. Ware was the surveyor who produced an inventory of Joseph's lands when they were divided up amongst his heirs after his death.

This is where Joseph was an 'inspector' at one of the earliest warehouses for the state inspection of tobacco, located at Bernardsburg, aka Bamesburg or Crofton.

★ 23 Jan 1800: friends of Thomas Jefferson met in Richmond to decide on a course of how best to elect their candidate in the presidential election to be held in November.....county committees were formed and from Fluvanna County, included JOSEPH HADEN as a member. Joseph's father John, had property on Cunningham's Creek bordering one of Jefferson's tracts. Prior to Jefferson becoming Governor of Virginia, TJ also represented Joseph's father John, Uncle Zachariah, and brother Anthony in the courts, usually pertaining to land or labor. While Thomas Jefferson was Vice President under John Adams, as he was preparing to run for President, he hired "John Haden" to escort an Indian Delegation through "Albemarle County" Virginia. This likely was Joseph's brother, John Moseley Haden, based upon the numerous prior Haden relationships with Thomas Jefferson AND the fact that Joseph being a member of the Virginia House of Delegates, had the availability and means to be a liaison in communication with both.

*** 42 SLAVES was even for those days, a large number indicating the likelihood that Joseph who often went to Richmond, engaged in the buying and selling of slaves. The U.S. abolished the importation of slaves, in 1808.

★ Dec 1819-Feb 1820: represented Fluvanna Co. in Virginia House for a 10th - final term.

★ 9 Oct 1820 - will dated and 27 Nov 1820 - will probated, which made specific bequests to daughter POLLY MARTIN, grandson ROBERT H. T. STRATTON, SAMUEL D. & MATILDA RICE children of dau JOANNA RICE, grandson JOSEPH T. HADEN, friend THOMAS HUGHES and others. The balance of the estate was to be divided into 9 parts to his children or their heirs. The book "John Haden of Virginia" lists Joseph's heirs as of 1835, in connection with the settlement of his estate:

William "P." Haden - listed as an executor, should be WILLIAM TRIGG HADEN, son of Joseph's oldest son Matthew. Other executors: JOHN N. HADEN and MATTHEW H. RICE.

Died on October 25, in the 69th year of his age, Capt. Joseph Haden of Fluvanna County, a soldier in the Revolution, a member of the Virginia Convention and for many years represented his County in the state legislature.

Like his brother John Mosely, Joseph remained in Fluvanna County until he died.

By 1815, Joseph Haden had remarried to Jane Turner, since a court record from that year shows they brought suit in Fluvanna County Chancery upon William Cunningham and his wife Mary, for a debt to be paid. Since Jane is not mentioned in Joseph's land division case/settlement, its likely Jane died before Joseph.

The court file pertaining to the division of Joseph's estate after his death, contains four different plat survey maps, split into lots for his 9 descendant children's legacies and friend Mr. Hughes. The lot/plat descriptions also include his home, half acre family cemetery - marked with 4 corner stones and 1300 plus acres (2 sq miles) with metes, bounds, poles, on Byrd Crk, Horsepen Crk, and Elk Run by Whitehall Road → todays' Byrd Creek East Branch. A compendium of the aforementioned lands is as follows . . . . .

In the obedience to the order and decree of the Worshipful Court for thew County of Fluvanna, we the subscribers hereto named in said order and decree as commissioners to divide equally the lands or Real Estate of Joseph Haden deceased we have proceeded with the assistance of Peter Ware, Esq. Surveyor for Fluvanna County to divide the said lands or real estate as in hereafter describe the plats of said lands will accompany this our Report and the dividing lines the number of each lot and part of lot as in hereafter designated that is to say,

Lot No 1 includes the Mansion house of said Joseph Haden deceased containing by survey Twenty acres and a half. This Lot consisting of the Burial Ground containing a half acre and designated by stones at each corner planted for that purpose. There is also added to this lot the one half of the land lying on the north side of the White Hall Road designated in the plat and numbered 1. It being part of the tract called and known by Crank's Tract lot drawn for the Representatives of Joseph Haden JR. deceased.

Lot No 6 first part contains by Survey sixty six and three quarters acres Including part of the tract called Clarkes tract [on east side of Byrd Crk] with the Mansion house of the same, the second part contains the other half of land lying on the north side of the White Hall Road known as Cranks tract which was added to Lot No 1. The two parcels of land above described are marked in the plats with No 6 and constitute that lot and was drawn for the Representatives of Joanna Haden afterwards Joanna Moon and Joanna Rice.
