He was appointed the US Land Commissioner while located in Carter County, Montana. He first married Eliza A. Smith 17 Jul 1872 at Boston, Massachusetts. Mortimer and Eliza had daughters named Emma and Grace R. Tracy. Later Mortimer married Jeanne Thomas who is buried beside Mortimer.
