Of Choctaw-Chickasaw descent. His family was part of the Mount Tabor Indian Community. The CSA troops mustered in at Bellview (present day Pirtle) were organized by John Martin Thompson (Cherokee, grandson of Judge John Martin of the Cherokee Nation), who was a 3rd cousin of Nicholas.

Enrolled in Company D. 14th Texas Infantry CSA in Bellview, Rusk County, Texas on March 15, 1862
