Harold Shubert, 24 years old, an actor living at The Lambs, and Miss Elsie Nichols, who were arrested Saturday night at Fifty-second Street and Eighth Avenue on charges of disorderly conduct, were exonerated yesterday in West Side Court and Magistrate Glatzmayer rebuked Patrolman Phillip DeNezzo for pursuing them after he had served a summons on Shubert for driving his car past a standing street car. The policeman testified that Shubert said he would send him "out to Staten Island with the rest of the goats" when he served a summons on the actor and that Miss Nichols had thumbed her nose at him and stuck out her tongue. Shubert denied having made the statement and Miss Nichols denied his charge against her. Both denied also that they had run past the car and said the policeman was insolent.
Phillip DeNezzo was located at headquarters 41 Waldron.

The judge dismissed the complaint. Patrolman, Thomas Dinnezo, of West 47th Street Station told magistrate Glatzmeyer that the trouble had started early in the morning after he served a summons on Miss Nichol's companion, Harold Shubert, an actor, for a traffic violation. Upon Shubert starting away in a car, he said Miss Nichols turned and made the objectionable grimaces. He gave chase in a department car and served them with a summons.
On her passport dated July 3, 1923 she is described as follows:
Age 17; 5 ft 4 3/4 inches tall; blue eyes; straight nose; blonde hair; fair complexion; round face.
