In 2000, Madgie Pate Strickland filed suit to restrict further burials in Jones Cemetery after first seeking quite title to the property. As a result of the court case, the court ruled that Madgie Pate Strickland owned fee simple title to the Jones Cemetery property, but that descendants of those previously buried in Jones Cemetery retained rights to be buried on the property. Furthermore, descendants of Daniel Lee Tubbs secured rights to their family plot, "commencing at the headstone of Shepard and Clara Belle Tubbs and running north and south the length of the cemetery and parallel to the east fence." This easement split the Jones Cemetery in half with the western half now referred to as Jones Cemetery while the eastern half is referred to as Windham-Tubbs Cemetery. These "cemeteries" are merely sections of what has historically been known as Jones Cemetery. It is also important to note that there are some descendants who share family who are buried in both halves of the cemetery.
