Daniel was the youngest child of John (d. 1780) and Elizabeth Thompson Payne (d. 1783) of Kershaw County, South Carolina. Since his parents both died before he was an adult, he may have gone to live in the home of his sister, Rachael (b. 1762) and her first husband, Samuel Belton, a wealthy planter in the area. From a Bible record left by his parents, the exact date of Daniel's birth is known, but his actual date of death is not confirmed. Daniel was ill and made his will out on January 13, 1807, but the will was not proved until March of that year. Daniel was scheduled to show up in court in Tattnall County, Georgia by February 3, however, and when he did not appear the court was informed that he had died prior to the scheduled court date. A good guess would be that he died sometime during the latter half of the month of January.

Daniel married Nancy Wright about 1796 in Kershaw County, South Carolina. The couple had five children, all but one born in South Carolina. The fifth, Abijah, was born after the family had relocated to Tattnall County, Georgia about the time of the 1805 Georgia Land Lottery. By the time of Daniel's death, he had amassed about 1700 acres of land as well as several slaves. His will mentioned each of his five children and his wife, Nancy, who would become the executrix of his estate over the next eleven years. Daniel provided for his family well enough that Nancy did not see the need of remarrying. She and her children remained loyal to one another and even moved together to Morgan County, Alabama by the time Daniel's property was put up for sale in 1818.
