Oscar Agee was the son of Sarah Elizabeth Lady and Benjamin Coats Agee. His parents and grandparents emigrated from DeKalb County, MO to Yamhill Co, OR in the early 1850s. Oscar's family moved to Douglas County, OR. He had 13 siblings.

He married Charlotte Isabel "Lottie" Lenox on 30 October 1892 at Roseburg, Douglas County, Oregon. They had the following children: Murlin L., Alma Olivia, Vern Agee (d. infancy), Maurine Agee (d. infancy) and Alleen Agee (d. infancy).

He appeared on the 1900 census at Happy Valley, Harney County, Oregon, on the 1910 census at Meadows, Washington County, Idaho, and the 1920 census at Poulsbo, Kitsap County, Washington.
