EP Day was the eldest son of Thomas Gordon Day and Sarah Rebecca Birch; his mother survived him. His paternal grandparents were Martin Penn Day and Louisa Tate. His maternal grandparents were Neat Randolph Roland Birch and Charlotte Ann Fletcher. All of EP's grandparents lived in St Helena Parish. EP had 12 siblings: Louisa Annie, Joe, Dewitt E, William Elzy, Hausey, Purcell, Clara Rebecca, Nancy Ozie, Collins, Gladys, Van R, and Gordon Oliver.

Emmett Penn Day married Lula Lorena Allen, daughter of William Elbert "Willie" Allen and Sarah Rebecca "Sally" Williams, on 22 Dec 1912 in St Helena Parish. They were the parents of 5 children: Reid Ellison Day, Wilma Grace Day, Dorothy Nadine Day, and twins Evelyn Corinne Day and Robert Emmett Day. All his children survived him.
