I Henry W Smith Clerk of the Probate court of Floyd county certify that on the 18th day of Jul 1840 John Ellis and William Harman appeared personally before me and having been duly sworn did depose and say that the Original insturment in writing filed in my office, and of which the following is a true copy and purporting to be the last will and testament of James M harman therein named of the county aforesaid deceased was duly signed and sealed by the said James M Harman on the day of the date thereof in the presence of said Ellis & William Harman who signed their names thereto as subscribing witnessess in the presence of each other, at the request of the said testator to the due execution thereof and there declare the same to be the last will and testament in the presence of the said deponents and the said defendant furthur say that they understood and verify believe that said testator was at the time of the execution thereof of sound disposing minid and memory and that he has since deceased.

In the name of God I now make my last will and testament being of a sound mind although weak in body as follows vis I want my wife Lucy Harmon to have all my personal property and the farm we now live on except the money loaned out and other debts till my youngest child becomes eighteen years of age if she lives in my name, I want Moses Harper after my death to be my executor and to collect all debts dues and demands and also settle all my debts. I also authorize Moses Harper to sell my right Share in the farm my father Mathias Harman willed to me which he called his other farm when he can get two hundred dollars for it and I want him to receive the money for it if the court should sell it or order it sold when application made for a division and I want him to receive the rents and profts of the said farm until it sold. I want the above named Harper to loan out all of the money he collects for me after he settle my debt and I want him to give my wife Lucy Harmon the interest of Money and rents of the above named farm annually until it is sold. I want Moses Harper my executor if my wife Lucy Harman shall decease or marry before my youngest child becomes eighteen years of age or at the time my youngest child is eighteen years of age I want you to make an equal division of all both real and personal estate amongst my children after giving my Lucy Harman her lawful share in testimony whereof I have hereto set my hand and

State of Indiana I Henry w Smith clerk of the probate Floyd County court of county of Floyd in the state of Indiana do certify the annexed to be a true copy of the last will and testament of James M Harman late of the said county, deceased and that Moses Harper the executor therein named, hath duly proved the same according to law and is duly authorized to take upon himself the adminstrative of the estate of the said testator according to the said will and the said Moses Harper has filed in said county his bond in the sum of and taken the oath as presented by the statute this 18th day of July 1840.
