WILL OF GEORGE MARLIN MCWHIRTER AT MARCH TERM, 1897, WARREN CO. COURT

KNOW ALL MEN, by these presence that I, George Marlin MCWHIRTER of the 3rd civil district of Warren County state of Tennessee. Considering the uncertainty of this life and being of sound mind and memory do make declare and publish this my last Will and Testament.

FIRST:
I give and bequeath to my daughter Sallie Catherine MCWHIRTER a certain piece or parcel of land described and bounded as follows, commencing on a stake in Jerimiah JACO'S south boundary line 15 poles east of Bud PENY house running hence south 16 poles to a stake thence west 30 poles to a stake thence north 16 poles to said JACOS' line thence east with said land 30 poles to the beginning containing 3 acres.

SECOND:
I give and bequeath to my son John Alexander MCWHIRTER my daughters Sarah Elizabeth CANTRELL AND Ellen H. PAYNE my son Sampson MCWHIRTER my daughter Martha E. CLARK, Lucinda Caroline GIBSONS heirs and Margrette Perlina PERRY all that tract of parcel of land conveyed by James H. RHODES to John CUNNINGHAM and by said John CUNNINGHAM TO George Marlin MCWHIRTER and wife containing 124 acres except the 3 acres described above and given to my daughter Sallie the above to be equally divied.

THIRD:
I give and bequeath to my daughter DAUGHTER SALLIE Catherine MCWHIRTER and my sons Newton Powell MCWHIRTER and Wade Hampton MCWHIRTER all of a certain tract or parcel of land conveyed by Mary WORTHINGTON, William RENSHAW, and wife to George Marlin MCWHIRTER and containing 26 acres also of a certain tract or parcel of land conveyed by J. E. RAWLINGS to George Marlin MCWHIRTER which land are fully described in deeds held by me these two tracts of land to be equally divided between heirs aboved named.

FOURTH:
I want my sons Newton and Wade each to have a bed and bed clothes sufficient and Sallie to have her bed and bed clothes and her sewing machine. I want and direct that sufficient amount of my personal property of which I may die seized and possessed of to be sold and all my past debts to be paid and all the rest of my personal property household and kitchen furniture, farming implements, stock etc. to be equally divided between my three children that are now with me, Sallie Catherine, Newton Powell and Wade Hampton. I do nominate Obed Tucker GIBSON my to be my executor in testimony where of I have hereunto set my hand and publish this my last will and testament in presence of the witnesses below named this July 19th 1895.

Signed sealed declared and published by the said George Marlin MCWHIRTER as his last will and testament in the presence of us who at his request and in the presence have hereunto signed our names as witnesses.

George Marlin McWhirter was a member ot the Old Caney Fork Baptist church he was Baptized in his wheel chair by Rev. McPeak and brothers. He and his wife Sarah Cunningham is buried on his farm now owned by Mr. Gerald Grissom and wife.

Warren County Tennessee Record 1858

This indenture made and entered into the 18th day of December in the year of our Lord 1858, between George Marlin McWhirter of the county of Warren and the state of Tennessee of the one part and Watson Cantrell Junior of the other part; Wetness that the said George Marlin McWhirter for and in the consideration of the sum of three hundred dollars to him in hand paid the receipt whereof is hereby hath bargained, sold and confirmed unto Watson Cantrell Junior his heirs and assigns forever two certain tracts or parcels land both lying and being in the county of Warren and state aforesaid in district number eleven on the waters of Dry Fork of Barren Creek, and bounded as follows, (to wit)

First tract beginning at a Post Oak about 10 poles North of John R. Pirkins North East corner of his one hundred acre survey, running thence east 80 poles to a stake in a glade; thence South 100 poles to a Black Jack; thence East 80 poles to a stake and said Pirkins east boundary line; the whole containing fifty acres the same more or less:

Second tract; Beginning on Harden Husis west boundary line of his seventy five acre survey running South with Husis line twenty 8 poles to two Dog Woods his South West corner; thence east with his line 48 poles to a Black Jack; thence South 80 poles to a Post Oak, on William Roberts North corner in all 86 poles to a Black Jack ; thence North108 poles to a Black Jack ; thence East 38 poles to the beginning the whole containing 50 acres, to the same more or less: with all their appurtenance to him the said Watson Cantrell Junior and to the only proper use and benefit of him the said Cantrell his heirs and assigns forever and of George Marlin McWhirter doth for himself his heirs and do warrant and forever defend the above tracts or parcels of land from any claims under him and his heirs to from the legal claims of all other persons whatsoever unto the said Watson Cantrell Junior his heirs and assigns forever . In witness whereof the said George Marlin McWhirter hath to these presents set his hand and affix his seal, the day and year above witnessed in the presence of us.

Personally appeared before me, J.M. Robertson Deputy Clerk of the county court of said county. George M. McWhirter the within named bargained this day whom I am personally acquainted and who acknowledged that he executed the within deed of conveyance for the purposes therein contained.
