He married Elizabeth Myers on November 2, 1820 at Bucyrus, Ohio. After he married he attended school and studied surveying and was always a student , he became a well-informed man. He was a life-long Democrat and active in politics.
He was elected associate judge from his district in Ohio on the Democratic ticket, which he held until his death. His wife also reached the advanced age of ninety years. To this union were born nine children: Andrew Failor, Abram Jefferson Failor, Katherine Elizabeth Failor (died young), Benjamin Failor, Margaret Jane Failor Mirchell, Samuel Failor, Mary Jane Failor Lyday, Elizabeth Failor Fullerton and Cecilia Failor Cook.
