Luty entered army service during the Civil War at 2nd Lieutenant, Company D, 103rd Regiment, Ohio Volunteer Infantry for a term of 3 years. After promotion to 1st Lieutenant, Dec. 2, 1862, he resigned his commission, February 9, 1863. His name is on Panel #13 in the Cuyahoga County Soldiers' and Sailors' Monument, Public Square, Cleveland, Ohio. See www.soldiersandsailors.com for more Monument info.

1870 U.S. Census shows him residing in Euclid, Ohio, a dry good merchant with wife, Mary, 24, and sons, Howard, 7, and George, 2.

His Grave Registration Card, compiled as a Works Progress Administration project during the Great Depression of the 1930s states that he died in Aberdeen, Mississippi of blood poisoning. This has yet to be confirmed.
