David Kuhn, Midland, pleaded not guilty in Bay City late yesterday to a charge of negligent homicide brought against him as driver of an automobile which crashed into a culvert early Tuesday morning, killing Floyd Decker, 26, this city, and seriously injuring Leon Penney, 26, also of this city. Both were with him in the machine.

The crash happened about five o'clock Tuesday morning two miles east of Auburn on the Bay City pavement when the car left the highway, ploughed along on the shoulder for about 200 feet and struck a culvert on the north side of the road.
(continues) Decker was killed instantly, it is believed his neck fractured.
(continues) Questioned, he (Kuhn) said a flat tire had caused the accident.
