Known as prisoner #5672, Curtis entered the penb almost three years after his cousin Edward Caviness escaped it. A commutation of his sentence was granted in 1904. The Colorado Transcript of January 14 was published in Jefferson County.

"Three prisoners in the state penitentiary had their sentences commuted to shorter terms by the State Board of Pardons on the 8th, but no pardons were granted. Four applications for murderers were refused. In the case of Curtis Caviness, sentenced from Huerfano County February 26, 1903, for a term of three and a half to ten years, following his conviction on a charge of assault to kill, the board commuted the sentence to from one to ten years. If, he is released when the minimum term expires he will be free next month. Caviness is said to have had a good record prior to his conviction. He has a wife and several children to care for and is anxious to locate to Pogosa Springs and take a new start in life."
