In the name of God Amen
I Isaac Hawes now in Danby Tompkins County State of New York being of sound and disposing mind but calling to mind the mortality of my body do make and order this to be my last will and testament as follows - I commit my soul to God who gave it and my body to the dust from whence it was taken to be buried in a decent Christian manner and with respect to such wordly estate as it has pleased God to bless me with, I will that it be disposed of in the following manner. Viz All my just debts being first paid - First - I order that my beloved wife be supported out of my estate during her life She remaining my widow and I do give and bequeath the [w]hole of my personal and real estate to my sons and daughters Limon [Lyman] Hawes, Josiah Hawes, Philow [Philo] Hawes, Newton Hawes, Prince [Pline is a mistranscription] Hawes, Isaac Hawes, Enoch Hawes, Lowman Hawes, Chloe Clark, Polly Hawes, Iram Hawes- it is my will that my daughter Polly should be supported out of my estate as far as she may need it. It is my will that all my landed property and all the property I have in the town of Warren be sold as soon as it can be with propriety - and I do constitute and appoint my son Philo Hawes as my lawful agent to transact this Business for me while I live and do constitute my Son Philo Hawes and my son Isaac Hawes as Executors and administrators to execute this my last will and testament. Each of my sons mentioned in this will having received of me one hundred pounds lawful money of the State of Connecticut for which I have receipts of each and all if them and my daughter Chloe Clark having received about two hundred dollars, that above receipts were given for donation they received out of my Estate as part of their portion and is not to be taken out of what may belong to them after my decease.-- But any notes of hand that shall be found against any of them in my favour shall be taken out of their part after the division is maid--provision is hereby made in this will for my son Philo that he shall have a proper compensation for all the trouble or cost that he may be at in taking care of us his aged parents and his Sister Polly. Accd I do direct and ordain that all my estate personal and real be divided equally among my children above named who are my lawful heirs - after my decease --I do likewise direct that if any one or more of the heirs shall be disposed to dispute or quarrel they shall forfeit their right to their part and their part so forfeited shall be divided equally among the rest of the heirs and lastly I do hereby constitute and appoint my two sons Philo and Isaac Hawes to be Executors to this my last will and testament -- In testimony whereof I have set my hand and seal this 12 day of September 1823.
In the presence of Hudson Jennings, Herman Smith, Wealthy Smith--Isaac Hawes {LS}

As my daughter Polly has got married since the forepart of this will was wrote in which it was said she should be supported out of my estate as far as she might need it -- But now I will that Polly Butler have two hundred dollars out of my estate with what she has had and the some she has had is on my Book about 94 dollars and Chloe Clark has had about two hundred dollars which is on my Book and where Chloe and Polly are near equal I think the will can be fairly understood.--Isaac Hawes

Having pleased Almighty God to receive by death my son Philo Hawes who I had appointed my Executor and administrator of this my will who is now decease I do now direct that what was willed to him shall be transferred to the rest of my heirs that may be living at my decease. I do also appoint my son Iram Hawes as an assistant to his brother Isaac.
