Stone reads "Our Father" and "The God of Jacob was his God"


Born to John and Elizabeth O'Briant Kirk in Green Valley, Montgomery Co, (later became Giles Co) VA. He served as a Private on active duty in Capt. George W. Camp's Company, 4th Regiment, Virginia Militia, September 15, 1813 - March 10, 1814.* It is reported that he suffered a serious wound to one hand in the War of 1812. After he came back from the war, on January 1, 1816, he married Rutha Howe, daughter of Daniel and Nancy Haven Howe, and continued to serve in the local (inactive) militia.


His granddaughter Lena Anderson, in 1924, wrote about them:


"So Ruth was wooed and won by Captain Thomas Kirk, who had charge of several counties of what is known today as the Reserves. Being known for his wonderful voice which could be heard a great distance away in giving orders to his companies."


Thomas and Rutha Kirk left Virginia and moved to Livingston County, Missouri, in 1843. Thomas and two sons went to California with the Gold Rush, leaving his wife Rutha, three daughters and another son in Missouri. Thomas died in Sutter County, California, on April 27, 1875.

5) ELIZABETH ANN KIRK, b. 31/Jul/1826, Green Valley, Giles Co, VA; d. 7/Oct/1896, Edinburg, Grundy, MO.

6) JAMES HARVEY KIRK, b. 21/May/1829, Giles Co, VA; d. 6/Feb/1919.

7) NANCY HAVEN KIRK, b. 7/Jul/1832, Green Valley, Giles Co, VA; d. 1920, Livingston Co., MO.

8) RUTH JANE KIRK, b. 10/Oct/1834, Green Valley, Giles Co, VA; d. 9/Jun/1925, Forest Grove, OR.


Thomas lived in Yolo County in Dec 1857, at age 66, when he applied and received a War of 1812 Bounty Land Warrant, #78051-160-55, for 160 acres by his application #SO29833 dated 26 December, 1857. Thomas was 83 and living in Rome, Sutter Co, CA On 4 April, 1874, when he filed for a pension by application #SC21495.


Thomas died in Sutter County, California, on April 27, 1875 and Rutha died back in Livingston Co, MO, only three months later.


*Although his burial marker and the Albert J. Roof book, "Past and Present of LIvingston County, Missouri", state he was commissioned as a major in the War of 1812, Thomas's pension file (SC 21495) and wartime pay stubs confirm he mustered in--and out--with the rank of private.
