The son of Jacob & Fanny (Heiss) Herzog, his birth location is a subject of debate. Per the 1870, 1880, and 1910 censuses, he was born in Pennsylvania, but at his second military enlistment he claimed Virginia and he also reported that in the 1900 census despite having three times reported otherwise. In 1860, his family was living in Lancaster, Lancaster County, Pennsylvania, but he is not shown in that census living with them. A farmer and baker by trade, he stood 5' 6" tall and had dark hair and brown eyes. He married Mary Ann Broadbent ca. 1864 and fathered Grace (b. 01/09/67 - married Thomas L. Devereese), Frank (b. 10/08/71), Mary (b. @1874, d.
A Civil War veteran, he enlisted and mustered into federal service at Lancaster February 28, 1865, as a private with Co. D, 195th Pennsylvania Infantry, and honorably discharged with his company January 31, 1866.

On September 17, 1867, he enlisted in Baltimore, Maryland, with the post-war army, assigned to Co. C, 7th U.S. Infantry (reorganized to the 36th U.S. Infantry), and honorably discharged by general order August 25, 1870, at Fort Shaw, Montana Territory.

After his discharge, he lived briefly with his young family in Salt Lake City, Utah, before relocating to Omaha, Douglas County, Nebraska, where he remained until his death.
