Samuel Lemon Smith, who married Elizabeth "Paynter" in 1860, was not a Civil War veteran. He appears to have been conflated with a younger Samuel Smith who was a private in the 75th Regiment, Ohio Volunteer Infantry. (See: Find a Grave Memorial ID: 55154638.) A duplicate memorial, Find a Grave Memorial ID: 242373593, is erroneous.

Samuel Lemon Smith, son of "Mintie" (née Lemon) and Samuel Smith, was born in May 1829 in Brownsville, Fayette County, Pennsylvania. Brownsville is on the Monongahela River, which at Pittsburgh joins with the Allegheny River to form the Ohio River. Samuel Lemon Smith likely traveled down the Ohio River to Cincinnati, Hamilton County, Ohio, where by 1859 he was railroad agent.

Samuel L. Smith and Elizabeth "Paynter" were married on 24 February 1860 in Cincinnati. The bride, Ann Elizabeth Painter, was a daughter of Harriet and Thomas Painter, who then resided in Madison County, Ohio. The marriage ceremony was performed by W. L. Hypes, a Methodist Episcopal minister. The couple were enumerated on 2 June 1860 in Cincinnati: Samuel Smith, reportedly age 27, was a railroad ticket agent. He was listed in 1861 to 1864 Cincinnati city directories as an railroad agent. The 1862 and 1863 directories noted additionally that he resided in Newport, a town in Campbell County, Kentucky, across the Ohio River from Cincinnati. The couple's first child was born in 1862 in Kentucky; presumably in Newport.

Samuel L. Smith was registered for the draft in June to July 1863 in Campbell County. He was age 35, born in Pennsylvania, and employed as an express agent. A year later, he was among the men of Campbell County drafted for military service, but obtained exemption by paying a $300 commutation fee. (Samuel L. Smith in early 1865 was again selected for draft by lottery in Campbell County, as reported on 6 April 1865—the same day the Confederate Army of Northern Virginia was defeated in battle, forcing its surrender 3 days later at Appomattox.)

Samuel L. Smith was not listed in the 1865 Cincinnati city directory. The couple's second child was born on 16 June 1865 in Butlerville, Jennings County, Indiana. (Elizabeth Smith's sister was married in 1866 in Jennings County, and her parents were enumerated there in 1870.) Samuel L. Smith in 1866 was listed in the Newport section of the Cincinnati city directory.

Samuel L. and "Ann E." Smith were enumerated in 1870 in Cincinnati with three children, a servant, and Samuel B. Smith (age 38, presumably a relation). In this census, and in an 1872 city directory, Samuel L. Smith was Superintendent of P. W. Strader & Company's Omnibus Line. (An omnibus being a large, horse-drawn, enclosed passenger carriage.) In 1880, the couple had six children and a servant. Samuel L. Smith's occupation was not indicated.

In the 1884 Cincinnati city directory, "Smith Samuel," a machine hand was listed as boarding in Cincinnati's Riverside neighborhood with Geo. W. Bland, his co-brother-in-law. Smith's father-in-law, Thomas "Paynter," also resided there. Smith's son, Samuel P., also a machine hand, resided on River Road in the Sedamsville neighborhood.* (Samuel L. Smith's living arrangements may indicate financial hardship. There was a financial panic in 1884, in the midst of the depression from 1882 to 1885.)

The 1891 Cincinnati city directory compensates for the lost 1890 U.S. Census. Samuel L. Smith, a barber, was then living in Riverside, and his wife's uncle, James M. Painter was living with them (and confirming identity). His son, Samuel P., was a sawyer, also living in Riverside. His son-in-law Thomas W. Rosser (married to Anna) was living nearby.

Anna Elizabeth Smith died in 1896. Samuel L. Smith afterwards resided in Cincinnati with his daughter Flora Scott and her family (in 1900), and with his daughter Anna Rosser and her family (in 1910). Samuel Lemon Smith died on 6 February 1912 at the Rosser home, and buried at the Spring Grove Cemetery.

Samuel Lemon Smith's death certificate identifies his: place of birth ("Brownville, Pa."), parents (Samuel Smith and "Mintie" Lemon), and occupation ("Supr. of R. R. Omnibus Co.") It also reports that he was born on 29 May 1840, and died at the age of 70 years, 8 months, and 8 days. "Mrs. Thomas Rosser," Samuel Lemon Smith's daughter Anna, was the informant for her father's death certificate. The reported date of birth and age at death are obviously significantly inconsistent with other records.

Samuel L. Smith's reported ages in the 1860 through 1910 U.S. Censuses (and 1863 draft registration) indicate he was born between 1828 and 1833. The 1900 U.S. Census reports age 81, born "May 1829." The submitter is inclined to believe that, while people may be careless or disingenuous about their age, and thus their year of birth, their reported day and month of birth are usually accurate.

A "Graves Registration Card" also indicates that "Smith, Samuel" was born on 29 May 1841. It additionally claims his service from 1862 to 1865 in "Co. D - 75th Reg. O. V. I." This claim is false.

According to the Official Roster of the Soldiers of the State of Ohio in the War of the Rebellion, 1861-1866, volume 6 (pages 221, 230, and 253). Private Smith, age 19, enlisted for 3 years and entered service on 14 August 1862 in the 75th Regiment, Ohio Volunteer Infantry, was wounded on 2 July 1863 at Gettysburg, and mustered out on 26 July 1865. A pension card for "Smith, Samuel," of "Co. D, 75 Reg't Ohio Inf" and "H 22 and B 75 Ohio Inf," shows that he died on 5 Oct 1917. (His death certificate reports he was born on 29 Nov 1843 in Athens Co., Ohio.)

It is plainly evident that Samuel Lemon Smith and Private Samuel Smith are different persons. What is not clear is whether the conflation of the two men was simply erroneous, or intentional.

Notes

A household headed by Samuel Smith was enumerated in 1820 in Brownsville, Fayette Co., Pennsylvania. Anna Elizabeth Painter's grandfather, Joel Painter, was then enumerated in adjoining Bridgeport (now part of Brownsville Borough). Anna's father, Thomas Painter was then about 4 years old. The Joel Painter family journeyed down the Ohio River to Cincinnati by 1830.

Two Samuel Smith households were enumerated in 1830 in Brownsville, Fayette Co., Pennsylvania.

Card of Thanks regarding death of Samuel Lemon Smith. ("Deaths," The Cincinnati Enquirer, Cincinnati, Ohio, 11 Feb 1912, p. 5, col. 3.
