John Abernathy died at the age of 68 years.

A soldier in the American Revolutionary War.
John Abernathy's will dated 18 April 1816 (original will photocopied at NC Archives and abstracted here) says: to wife Susana, to youngest daughter Polley to have good suport as long as she remains single, to Patsy Thompson, first daughter, the Negro girl she now has called Sarah and 5 dollars in cash as her full part of the estate Amy Oliver, second daughter, is to get equal part of the property then on hand as the other eight of my children namely Jerimiah my first son & Harley my second son, Bary my third son & Lot my fourth son and also is to live where he now lives until then & also Claton my fifth son is to be equal with the rest and Larkin my sixth son the same, Faney Little my third daughter the same, Polley Abernathy my fourth daughter the same and exclusive of that she is to have the Negro Girl Mass, a bed and furniture cupboard and table furniture but if she dies without issue is to be divided among the legatees. Appointed my son Harley Abernathy my second son and Bary my third son my Executors. Witnesses: William Heker, Jurat, William Nancy, John Nantz. Berry Abernathy and Harley Abernathy sworn. Proved July session 1816 by oath of William Heker.
The file contains John Abernathy's original will (at NC Archives 17 June 2003) and a typed transcription of it. Although now preserved, the original will has a few words missing which the transcription fills in. Along with this tanscription is an affidavit by R.B. Oliver dated 22 March 1930 that says he [Mr. Oliver] and his wife, Marie W. Oliver, first saw this will at the Lincoln County, NC court house in August 1899 and requested of Mr. A. Nixon, Clerk of Superior Court in Lincolnton a true, full and complete copy of the Will. In a few days, Mr. Nixon mailed it to him at his [Oliver's] home in Cape Girardeau, Missouri. He further states that this copy is a "full, true and perfect copy of the copy of said will as furnished him by Mr. Nixon, as Clerk of said Court." When the Olivers again visited Lincolnton in May 1923 and asked to see the original will the clerk "reported the original will was in storage and was not accessible on account of the reconstruction of the court house... affiant further states that he is the great grandson of John Abernathy, deceased, and that from family writings and a diary kept by his grandfather who was the son-in-law of John Abernathy, he has learned the names of all the children of John Abernathy, deceased, and that he verily believes the names set out in said Will are the names of the children of said deceased ..."

Other John Abernathy information from "Oliver Manuscript" says John was in the Revolution, died 1816 and is buried on his plantation on the Catawba River in North Carolina. One note in this file is by Dr. Jno Scott regarding his last visit to John Abernathy on 7 May 1815. Another document is dated 12 May 1816 "list of Property of John Abernathy" includes 280 acres and 8 Negroes: Nann, Sarah, Meriah, Masse [?], Ozban, Eliza, Vilet, Jiney [Siney?] by Bary Abernathy.
