Eldest child of Banyan Payne (1800-1878) and his second wife, Malinda Ann Thompson (1804-1841), John was named for his grandfather, another John Payne, Blacksmith, from Kershaw County, South Carolina.

Dr. John L. Payne graduated Magna Cum Laude from the University of Tennessee at Nashville in 1862. He got his Medical Diploma at the same time as Dr. James Elliott Blaydes, who later married John's sister, Malinda E. Payne. They had gone to medical school for two years to become doctors. Shortly thereafter, John L. Payne served as a Captain in the 12th Tennessee Calvary, Company C.

After marrying Mary Frances McGregor in 1861 and after his home was burned in 1863 by Yankees, John and his family moved to land in Hays County, Texas which had originally been bought by John's father Banyan. John and Mary Frances had eight children, four of whom were born in Texas.
