WIDELY KNOWN ATTORNEY FAILS TO RALLY AFTER FAINTING SPELL

Judge R.F. Hamilton, Deming pioneer, died here late Friday afternoon at his home here. Death came unexpectedly, although Mr Hamilton had been in failing health for several years.

R.F. Hamilton was born Aug 24 1869 at Plainfield Wisconsin making him 66 years the date following death. Prior to entering law school of the University of Wisconsin he graduated from that institution in 1895. He immediately commenced the practice of law. For a time he was prominent in politics in Wisconisn, having been district attorney of Green Lake county for one term, and for two terms, during which he was located in Madison, the state capitol, he was Assistant Attorney General of the state. During his last term as Assistant Attorney General, Robert La Follette was governor of Wisc.

After relinquishing that office Mr. Hamilton became a member of the law firm of Warner and Hamilton during the years 1903 - 04 as a private practice. In 1905 he went to Tonkawa Oklahoma and was there until Nov 1906 when he came to Deming, New Mexico to make his home. This was 29 years ago.

He enjoyed an enviable reputation as a lawyer in both civil and criminal cases. Among important cases in which he has appeared was his defense of William Gibson charged with murder in Grant County. He prosecuted Starr and Schmidt in Dona Ana County for killing Sheriff Dwight Stevens. Starr was sentenced to be hanged, and after his sentence was affirmed by the Supreme Court of the state, took the case to the Supreme Court of the United States, where the action of the state courts was sustained. His death sentence afterwards was commuted to life imprisonment. He prosecuted J. L. Gates for the murder of Tom Hall and Ranger Smithers in Socorro County. Gates was hanged at Socorro.

He defended 16 Villistas brought from Mexico by General Pershing, they being charged with murder as the result of the Columbus raid. They were acquitted. Prior to the trial of these, 6 other Villistas, who were implicated in the Columbus raid, had been convicted and hanged at Deming.

He was frequently employed by the Southern Pacific Company, also by the Chino Copper Company, to assist in the trial cases in the local courts

Mr Hamilton served as mayor of Deming from 1918 to 1924, having been elected three times on a non-partisan ticket. At the time of his death, he was serving as City Attorney.

Funeral services were conducted from the Mahoney chapel Monday morning at 10 o'clock. The floral offering which covered the casket and completely filled the chapel altar bore silent testimony of the esteem in which the deceased had been held. Miss Emme Garcia and Sidney Wells accompanied by Mrs Sam Fulton sang "My Rosary".

Masonic services were held at the grave and burial was in Mountainview Cemetery.

Aside from his widow, Mr Hamilton leaves 2 sons, Alexander R. Hamilton of San Bernardino CA and John Hamilton of Deming and 1 daughter Mrs E. G. Herlily of Atlanta, Georgia, who have the sympathy of the community.
