Emily was married to William Welch a well to-do landowner on Patrick's creek about 1856. They are living next door to the Hamilton's in 1860 and their first child Sarah is one year old. Emily Walch became a member of the Church of Christ in Weatherford in September 1868. After being married for 14 years and 7 children, Emily and William seperated, signing an affidavit in August 1870 to the terms of the seperation. Citing that she knew he had legally divorced his first wife in 1855 when she married him, her "present religious beleifs" would not let her continue to live with her husband. She agreed to $1,000 giving up all claim to William Welch's future estate, and that a divorce might be in the future. She took two of her seven children, Emily age 5 and Mary an infant. She is living in Johnson County on the 1880 census with the two girls. the 1875 will of William Welch lists the other five children, Sarah who married Cass Brooks, Lucinda who married James E. Pugh, Felix, Joshua, and Solomon. They and Emily and Mary Welch were included as heirs of William. The agreement between William and Emily was filed March 27, 1878, after the courthouse fire of 1874.
