Herbert was born on April 4, 1865, in Rhode Island to Harriet and Orange. While at Brown University, he was an active and accomplished student, a member of the Delta Phi fraternity, the Brunonian yearbook staff, and the football association, and a winner of prizes for his scholarly studies. After graduating in 1889, Herbert pursued a legal career. He was admitted to the bar in 1892 and worked as a lawyer in Providence for a few years from 1892 to 1893.
In the midst of his college trajectory, on December 28, 1888, Herbert married Sarah Janette Vaughn at the Trinity Methodist Church in Providence. Tragically, their only child, Henry Vaughn Parmenter, was born in 1892 but died as an infant in 1894, compounding the devastation of Herbert's own premature death just a year after being admitted to practice law.
