Mrs. Marian Berry of New Durham, N.H., a widow lady, aged 65, was shot and killed in her own house and in the presence of her family by a man who had been employed by her to do some chopping. There had been a dispute about the payment and Pinkham , who was under the influence of liquor, entered the room and, after a few words, shot her through the head. Later he was found about a mile down the road with his throat cut. His wound is not fatal.

John Pinkham, executed at Concord, N.H., for the murder of Mrs. Marian Berry, near Durham on January 9, 1878. He was a farm hand and rather weak minded, and had a quarrel with Mrs. Berry for whom he worked about a small sum of money, and after the quarrel withdrew, got his shotgun, and returning, shot Mrs. Berry through the heart. He expressed a willingness to die for his crime. He died without a struggle, his neck being broken.
