Mr. Whitman was elected as the fourth California State Controller on September 5, 1855, running as a member of the American Party. He took office on January 7, 1856.

According to the 1909 California Blue Book:
"On February 13, 1857, a resolution was passed by the Assembly impeaching Whitman for misdemeanor in office, and on the 24th, articles of impeachment were reported by a committee; the Senate, on March 9th, convened as a high court of impeachment, and on April 21st Whitman was acquitted. "
