Tabathia Kitterman is only found on the 16 day of August, 1860 census, she was 5 years old as the only child not mentioned in any other court proceedings.
This points to her premature death about the time Mary & George pass, after the 1860 census before David Kitterman bought the siblings portion in 29 August 1866. (David purchased portions from: Benjamin, Mary Stapleton, Nancy Kellams, Sarah Beard, George Kitterman, Susan Carter, Johanna Shoemaker, Elizabeth Kitterman, Malinda Blunk. Eliza Maria & Emily sell their portion to their brother in law 28 day of April, 1870. Being minors at the time of their parents death and without guardian's waited until they became of age to sell their portion.
In Court 27th day May, 1873 Benjamin, Amos and George Crutchfield (children of Anna Kitterman) along with John Kitterman and Caroline Kitterman who were living away sued William Carter for their portion that Emily and Eliza Maria had mistakenly sold.
Tabathia 5 & Caroline 10 were minors, as were Eliza Maria 14 & Emaline 15, 1860 census, and did not have standing to sell their portion to David.
Caroline & John are seeking claim and successfully won claim as did the children of Anna Kitterman Critchfield named above.
