Sam Cookston, John Toms and Kirk McCowan were allegedly robbing and harrassing residents. Sheriff W.W. Banks, Deputy Levi Whiteman and a young man named Johnston confronted the trio. Johnson approached Cookston and asked for his pistol. Cookston pressed the gun against Johnson's chest and said, "No damn man should have his gun". Whiteman told Cookston he was under arrest. As Whiteman advanced, Cookston shot him in the stomach. He died instantly. Sheriff Banks wounded Cookston, but he escaped. Tom's and McCowan were arrested.

Deputy Whiteman was survived by his wife and five children.
