IDENTITY:
Benjamin Herndon (born 1806) died after 1850, in Dec 1851 or Jan 1852, probably Jan 1852, definitely before the 6 Jan 1852 when letters of administration were granted for his estate, and the 17 Jan 1852 estate sale and year's provisions were granted for his widow Polly. (REF: Stewart Co TN Settlements and Bonds, Vol. XX, pages 3, 36, 44.) This Benjamin matches ages for household head in the 1830-1840-1850 US Federal Censuses of Stewart Co TN.

CONNECTION:
Benjamin Herndon (1806-1852) is likely the GRANDSON of Benjamin Herndon (1760-1814), husband of Ann "Nancy" Newton, through their SON William Herndon (1783 VA-1831 TN).

WARNING:
To further muddy the water, there is still another Benjamin Herndon in Stewart Co TN probate records, he died before 3 Oct 1842 when administrator's bond was entered for his estate, and the 15 Oct 1842 estate sale. (REF: Stewart Co TN Settlements and Bonds, Vol. E, pages 224, 237.)

ALERT TWO MEN SAME NAME SAME COUNTY:
Be aware that a Benjamin Herndon is first mentioned in deeds pertaining to Stewart Co TN in 1830, and there is nothing by which to establish his age or origin. Since the other one didn't die till 1842, it is difficult to determine which deed and court entries (1830-1842) belong to which Benjamin, whether to just one or whether to both. One was a Justice of the Peace and in one instance, one was referred to as Esq., so perhaps they referred to the same man or to two separate men. (FACT: In 34 Marriage entries, from 16 May 1838-25 Oct 1848, a B. Herndon is listed as administrating Justice of the Peace (J.P.), and only once identified by full first name as Benjamin Herndon.)
Deeds mention a Benjamin Herndon receiving 25 acres (REF: Trigg County, KY: Land Surveys South of Walker's Line in Stewart Co., Tenn., by Simmons, 1995, page 47 # 113.) In 1831, he also obtained additional land, 50 acres and 25 acres.

In 1832, there is a family-related land transfer from Benjamin & Mary Herndon to Elizabeth Griffin. (REF: Stewart Co TN Deed Bk 9, page 429.)
