Creath Hudspeth’s WILL [translated from handwritten WILL of Creath Hudspeth – some words were hard to translate]
Be it remembered that I Creath Hudspeth of the County of Calloway State of Kentucky being of sound mind and disposing memory and knowing the uncertainty of life and death sure and thereas God has blessed me with property personal mixed and real and now being of sound mind and memory any? give me soul to God who gave it and make this my Last Will and Testament revoking all others heretofore made.
1st/ I desire and will that my burial and funeral expenses shall be paid as soon as convenient as the Executors hereinafter named as they think wise and best.
2nd/ I now give and bequeath in briest? to my affectionate wife Sarah F. Hudspeth her natural life and for her use and benefit so long as she lives the proceeds arising therefrom by rents or otherwise arising from personal and real property that I may die? seize with consisting of personal mixed and real property in this state or in any other state in these United States that I have or may come to me through reversion or reverters? and at her death the reverters? is to be equally divided between my two sons Base? C. Hudspeth & James Hudspeth. Except as herein after made and provided for.
3rd/ I hereby give and bequeath to my son Base? C. Hudspeth $5 in gold if not on hand. Other personal property exchanged therefore and as he has made good listing and beneficial improvements upon the lands by building a house and out improvements to the amount of $150.00 out of his own means and money and as the death of his mother Sarah F. Hudspeth that he be compensated for said improvement out of the personal effects on hand if none on hand then out the real estate heretofore given in trust to my wife and that said improvement is to be roled at the assessed value of the land where said improvements was made same that the boys are made equal in all of my effects in personal and real property.
4th/ I give and bequeath to my son James Hudspeth $5 in gold out of my personal effects if not hand other personal property exchanged therefore in the event of any improvement he may make be allow him as set out Section Three.
5th/ At Sarah F. Hudspeth death then all of the remaining personal and real property shall be equally divided between my two sons except as set out in Sections 3 and 4 heretofore mentioned.
6th/ I hereby authorize constitute and empower Base C. Hudspeth and James Hudspeth Executors under this my Last Will and Testament. And to carry into effect the source as indicated herein and by qualify as such executors without Bond hereby revoking any and all Wills heretofore made and constitute the said Executors of this my Last Will.
In witness whereof I the above named testator of herewith set in hand and seal this the 13th Day of May 1899.
